Sorry to jump in on this thread.  I'm in a similar position in that I'm registered keeper and received notification out of time. I'm not asking for advice on my individual case as I'm familiar with the guidance on this form (and legislation, code of practice etc having previously won against Excel in court).

What is interesting to me is that it looks like NCP are routinely doing this - ie sending a threat of pursuing the Keeper when they are outside of the 14 days.  In my case, as with this one, even the 'sent' date on the letter puts them out of time.

This is a breach of the Private Parking Operator code of Practice.  Once incident is a Level 1 'non conformance', but if is routine then it would be a level 2 or level 3.  I will be complaining to NCP and highlighting this fact, as well as reporting it to the BPA who are supposed to audit these firms, as well as the DVLA.

It's also a breach of consumer protection legislation (The digital markets competition and consumers act 2024)  as a breach of professional diligence and arguably an aggressive commercial practice.

Definitely report them to the DVLA for lying about keeper liability !

THEY CAN'T SAY IT WAS A MISTAKE BECAUSE THE DATES OBVIOUSLY DISALLOW THEM FROM ISSUING A POFA NTK.

I agree - this is a misleading action or omission.

I've also seen a POFA worded one from NCP sent after 3 weeks to a friend of a friend, two years ago so it's ongoing conduct.

Please show your picture of it here in this thread (as the OP's one is sorted so it's not off topic) and it'll be easier for me to use as evidence for the Public Consultation. Please also make similar points yourself by all responding to the MHCLG's survey.

DTP93 did you do the survey already? If not:

    Consultation deadline extended:

    FIGHTBACK ALERT:

Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline.

    See this thread:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-now-extended-closes-friday-26th-september/p1

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

    CLOSES ON FRIDAY 26th SEPTEMBER.
