    OK, I've found the data privacy page. It's well hidden. the address is dp@horizonparking.co.uk but it looks like that's only for data privacy complaints. Should my wife use this to state that I was the driver and request that all future correspondence be addressed to me? Thanks for the tip off that this should be from her and not me.

    I wouldn't have suggested it if it wasn't a matter for the DPO.

    A registered keeper telling a DPO at a PPC that they need to pursue the driver instead is certainly a data protection matter.

    She must give your name and address.

    Gosh (not a term I would normally use but I'm abiding by forum rules), I wish I'd thought to look at this forum when we got the PCN. You people are so helpful and, I presume, doing all this in your own time

    I'm slightly confused as to whether the Private Parking Sector Single Code of Practice applies in my case as the land is owned by the City of London Corporation, but they have appointed a private parking operator to manage their car parks in Epping Forest.

    It applies to all new cases since around February 2025 to every private parking company AOS member 

    If a council own the land , then it's not relevant land under POFA2012

    The Notice to Registered Keeper says that the PCN is given to the keeper under POFA 2012 Schedule 4 Paragraph 9(2)(f) which seems to imply that the car park is on relevant land. However, the act states in Paragraph 3(1) that "relevant land" means any land.........other than..........(b) a parking place which is provided or controlled by a traffic authority. Paragraph 3(2) states that "traffic authority" means each of the following - ................(d) the Common Council of the City of London. So it's a bit of a mystery to me. The body responsible for Epping Forest is the Epping Forest and Commons Committee of the City of London, but that is a sub-committee of the Common Council.

    Never trust the weasel words of a parking company,  never assume that they tell the truth either 

    Castle says that bylaws apply,  reinforcing the not relevant land argument,  same as airports , ports and railway stations , no keeper liability 

    Parking Eye used to claim Pofa2012 at part of the Olympic site in London,  they were wrong there

    They are misleading the keeper about keeper liability. This is land under statutory control.

    However it is all moot, as the registered keeper isn't up for defending this case and will be telling the PPC that they need to pursue the driver instead.

    Then the POFA point goes out the window.

    However, if I may just whisper it again (but in bold):

    ...please please please do this on or before 5th September (end of next week): the government's Public Consultation.

    Yes we do all this in our own time and I've been on the government Steering Committee since 2020, completely unpaid, including a trip to the MHCLG HQ in Westminster at my expense in June. I hate scams and this is worth the fight.

    Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please!

    Yes, I will definitely do that by the end of this week and I greatly appreciate your efforts. Like I said earlier, it's a pity I didn't think to look on MSE for help earlier. I use it regularly for money, insurance and energy advice and I subscribe to the weekly emails but I didn't think to look for advice about parking.

    By the way, the Notice to Registered Keeper refers to "The terms and conditions of parking on this private land". It is clearly not private land as it is owned by the City of London Corporation and has to be kept as a public open space, so unless there is something I don't know I wonder whether in fact COLC has the legal power to appoint a PPC. I have looked at the Epping Forest Byelaws and I can't find anything about parking or Castle's point that only the driver can be liable.

    Only the driver can be liable because it's not relevant land. Not because of something written in the byelaws.
