On bin day, neighbour obstructs my front garden with their bins.

Yikes!
Most definitions of 'kerbside' suggest it's where the road meets the raised kerb. Others confuse this by saying it's on the kerb closest to the property boundary.
For refuse, it surely cannot be the former, as that would be a trip hazard?

For refuse, it surely cannot be the former, as that would be a trip hazard?'kerbside collection' means the waste receptacle should be left on the owner's property at the boundary, so the collection operatives can get it without entering private land (unless an assisted collection has been arranged), but not left obstructing the highway itself (unless there's no other option, such as for terrace houses with no front garden).Waste collection authorities can issue a FPN for waste receptacles left on the highway instead of the owner's property, unless it is impossible to do so (e.g. the terrace house with no front garden example), so they shouldn't be 'requiring' residents to obstruct the highway by putting their bins on the footway or verge in cases where people have perfectly good driveways or lawns that the bins can be left on to keep the footway clear. (but some councils can be a bit silly when it comes to making up rules about waste).In other uses 'kerbside' means the edge of the carriageway (whether there is a kerb or not) - i.e. the line separating the part of the road vehicles can be driven on from the part reserved for pedestrians etc, or a grass verge. Hence 'kerbside delivery' strictly means the vehicle will park on the carriageway at the kerbside (i.e. not your drive or shared access) and the goods will be delivered to a point on your property the driver/operative can reasonably get to either using a hiab or manual handling... it doesn't mean they will always leave your new fridge/TV/5t of sand in the road next to the kerb.1 -
This is clearly something that varies between areas, so people need to follow the instructions given by their local council.
In my area we are explicitly instructed to "Put your recycling and waste on the pavement for collection." They mention there may be penalties for obstructing the highway, but these are only threatened if you put waste out before 4:30pm the day before a collection is scheduled or leave empty containers out after 9am the day after a collection.
To receive an exemption from this - meaning the council will collect your waste from within your property boundary - you have to prove that "you are disabled and cannot carry the containers to the pavement for collection".

Do remember that if you sell up and move you will need to declare the ongoing neighbour dispute that will have been recorded by the police to any potential buyer if asked (its a standard question from solicitors).1

Here, every single bin is left outside the property border. It seems unlikely in the extreme that the entire population has it wrong. Possible, but unlikely.If the bin men pushed the bins back over the property line, I would be more inclined to believe the AI version.0

Please leave your bins at the edge of your property boundary next to the road before 6am on your collection day. Bins will be emptied and returned to the edge of your property.And yes, in the quiet close where I live the bin men don't always put it back over the property line.

Good point, ours have to be in the property right on the boundary so as not to cause an obstruction, but are left all over the place once emptied. The rule obviously only applies one way.Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.0 -

Possible, but unlikely.If the bin men pushed the bins back over the property line, I would be more inclined to believe the AI version.It is a bit like speeding.... what a very large majority of the population does isn't always a guide to what the law requires.Leaving a waste receptacle on the highway is an obstruction, which strictly would be an offence.But it is unlikely someone will be prosecuted (or get a FPN) unless the council's EPA 'requirements' are explicit that bins should not be left on the highway at any time - and if action is taken it is more likely to be under EPA and not the Highways Act.If someone's council says 'place the bins on the footway or we won't collect them' then that is what should be done... and if threatened with prosecution then the council's EPA requirements should be used as a defence.0

Frankly I think your neighbours have some strange health issues because it's not a normal thing to do.
Can you think of yourself as being kind to the afflicted and ignore this?
All neighbours are weird. I have one whose middle age son has moved in and leaves for work at 4.45, doesn't do anything for his elderly mum etc. perfect right to but leaves me in pain if I can't get a night's sleep. I just have to hope for karma to come sooner rather than later.
It's the irrational rather than a problem remember.I can rise and shine - just not at the same time!
