UKCPM PCN - non-PoFA compliant?

Hi all,

I have received this PCN from UKCPM when I was delivering goods to a building in Basingstoke. I compared it specifically to UKCPM PoFA & non-PoFA letters here, and suspect it's more on the non-PoFA side? Am I therefore right to assume they cannot hold the registered keeper liable and it could be appealled with the paragraphs below? Thanks in advance.

Appeal:

Dear Sir/Madam,

I am writing to formally appeal against Parking Charge Notice (PCN) XXX, issued to my vehicle. As the registered keeper of the vehicle, I would like to address the points raised in your notice.

You have outlined your belief that the driver is liable for the parking charge and invited me, as the keeper, to either pay the charge or identify the driver. However, I must inform you that the vehicle is driven by multiple individuals, and I am not in a position to disclose the identity of the driver at the time of the alleged contravention.

Furthermore, I would like to bring to your attention that your notice appears to be non-compliant with the mandatory requirements set forth in paragraph 14 of Schedule 4 of the Protection of Freedoms Act (PoFA). As such, I believe that you are unable to pursue any liability against me as the registered keeper.

Given these circumstances, I respectfully request that you cancel the parking charge. Please provide me with written confirmation that this charge has been revoked at your earliest convenience.

    It is non-POFA because the penultimate paragraph only claims to ever be able to pursue the DRIVER.

    No idea why they've used that version!

    I would even try an IAS appeal on that basis. UKCPM might offer no contest.

    While your cases are quiet, before the end of next week please please do the government's Public Consultation.

    We need every poster to come back & complete this vital Consultation before the deadline.

    We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

    I've written some guidance on that thread. I have covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

    Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

    Hi guys, I have received a rejection for my appeal. Here’s what they said:

    “… Either due to the reason for issue and/or the insufficient evidence provided to support the details of your appeal, we have considered this PCN and found that it does not fall under the category of Annex F the Appeals Charter of the Single Code of Practice. Therefore, if no further evidence is provided, we will deem this to be our final decision. 

    You have now reached the end of our internal appeals procedure and therefore you now have two options; either pay or appeal to the Independent Appeals Service (IAS) - you cannot do both.

    …”


    What should be my next step? Do I just have to pay at this point?

    Apologies for that @Coupon-mad, I completely forgot you mentioned IAS previously. 

    So what I am going to fill in the "Basis of Appeal" box on the IAS appeal form, will be more or less what I wrote to CPM in that appeal, right? And I am gonna attach both sides of the PCN letter too. Do you think there's anything else I could add to the appeal that would also be beneficial?
