    Thanks for all your replies,

I spoke to the police earlier, and passed it into Uber.

I will keep you all updated.

It's criminal damage to your property and certainly intentional.  you have 24 hours to report it to the police.
It doesn't sound criminal at all, just accidental damage.

Ask Uber about their liability insurance.

It could be criminal damage if the driver was reckless.  (ie didn't care whether he caused damage or not)

AIUI that would be sufficient to satisfy the mens rea of criminal damage.

whether the police would take action or not is another matter.
As I said, it's not going to help the OP get compensation either way, so they still need to pursue a civil claim. I think some people have the idea that the police are a publicly-funded debt recovery service.
You said it didn't sound ciminal at all, but if the driver was reackelss as to whether damage was caused, it could be a criminal offence.

If the OP reports it, it can't detract from any future cicvil claim they made...

Even if it is, the police are hardly likely to spend their time pursuing tenuous cases like that.

I'd have thought what's most important to OP is getting mobile so contracting his own insurance company (who could pursue Uber) would seem the quickest way to get a result. Surely he needs a replacement ASAP while any claim is being pursued.

Where should i go with it, as i am housebound now as my chair is knackered.

Shall i try the police or shall i go back for Uber and ask about their insurance.

    Thanks
You could try 111, but I would expect a full sorry. This is a civil matter.
I don’t think the NHS could help.
    🤦‍♀️

    Yea, 101 would be better..

So you're saying this Uber driver deliberately smashed your wheelchair in front of you? In which case yes it is criminal damage and needs pursuing with the police.

If the driver was just careless/clumsy handling it then it's a civil case and needs either claiming on your insurance (and they then claim against Uber) or you send a Letter Before Action.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Just an update ;

I sent Uber photos of the damage.
They're trying to fob me off with "I'll make sure you don't get that driver again"

    Please help.

    That sounds sensible.

Even an 'extra light' powered wheelchair weighs at least 25Kg, more with the battery attached.

No sweat for a guy who does weights in the gym but probably a struggle for many people who do a sedentary job such as taxi driving.

Plenty of advice given already about getting your damage fixed.
