    Hi guys

    So the template response that I used did not seem to work, I have have now received a Notice of Proposed Allocation to the Small Claims Track. Any advice of where I go from here would be appreciated. I'll have a look around the forum for any answers as well. Thanks

    Study the 8 steps that nobody seems to read in the first post in the defence template thread in announcements near the top of the forum by coupon mad 

    Too early for the defence template to work, perhaps next summer , you have a long way to go

    My other issue is that this was issued to my daughter at her Uni flat, yet they have sent this to my business address and my daughter leaves for Australia in 3 weeks time for 3 years, so the last thing I need is a CCJ on my business. I have until the 15th to respond on the N180

    Yep, but it's not in your name,  so you cannot respond,  the defendant must do so

    Download the N180 DQ pdf document from the government website,  get your daughter to fill it in and sign it and save it, then SHE emails it to the DQ email address at the CNBC in Northampton,  as an attachment,  and she CC the lawyer's as well,  DCB Legal,  using their info@ email address 

    One downloaded pdf, filled in,  and emailed to 2 destinations with one attachment,  mentioning the claim reference number 

    To be clear,  you cannot take over,  but you can assist her,  like I am assisting both of you,  as helpers

    The template defence has worked and has been accepted by the court system. Without it you would have had to deal with a default CCJ as a result of no defence being submitted. It is up to the claimant to now read your defence and decide whether they wish to proceed with a hearing by the 15th. You don’t have to do anything now but wait to hear from the court.

    Don’t know why the court would start sending papers to your business address. The claimant should be sending everything to the address your daughter has given them ‘for service’ and this would be copied by the court. If it is wrong you should notify the Data Protection Officer at the parking company as well as the court and ask they erase any former addresses.

    It might be a good call to do this after your daughter leaves the country and provide them with her new address in Australia for the foreseeable future. They might just give up altogether. 

    You do not need to worry about any CCJ against a person or a business address. If it went to a hearing and you lost the CCJ is wiped as long as you pay within the timescales given by the court (usually about 30 days).

    I don't know what you mean.

    Defence was just step 1 of 8 easy steps you were following. It includes this form.

    No CCJ is risked as long as you follow our steps and all court directions. Not even if it gets to a hearing next year and you lose (very rare).

    Obviously you'd pay if a judge told you to and it would be less then the claim ... this is already explained in the sticky threads.

    As an aside:

    You should have responded to the LBC before you even got the claim form. You could have killed this stone dead by naming your daughter at her Oz address and neither of you would have been pursued with a claim.

    To clarify something though because we are where we are, because the driver wasn't named at the Australian address:

    Are you saying the named DEFENDANT is you or is it your daughter (on the claim form)? Which of you?

    The defendant is my daughter, I am just assisiting her. She is not yet in Austrailia and has not yet got actual address to use in Australia yet. She will be there on the 27th December for 3 years.
