Group Nexus, DCB Legal court claim 2025, the driver parked in a disabled bay

    I was lead to believe that DCB and other PCN companies can and do often stop pursuing claims even after mediation… So that's nto the case? This will definitely go to court now? When I say "go to court", I mean the hearing will go ahead….

    I have covered it dozens of times

    They have no incentive to discontinue until just before the hearing fee is due

    Going to court is completely different than attending a hearing, many thousands of cases go to court, but only a few reach a hearing

    Your case is definitely going to court, but very unlikely to get to a hearing

    I've received a letter notifying me the court has decided it's suitable for small claims track.. I'm a bit confused by the letter though: on one hand it says I don;t need to attend, while it says in the notes I need to notify them.

    Also, it mentions me providing any documents I intend on relying on during the hearing to all parties (again, I'm not supposed to go, so not sure why it mentions this) while it also mentions havin things signed by a witness…

    Really not sure what i'm supposed to provide here or whether this is just routine instructions and doent apply to me.. Dont wanna get anything wrong in the final stage so any advice would be great :)

    Its standard stuff, with deadlines and directions etc it definitely applies to you, as well as the lawyers

    Interesting.

    It DOES say this will be a hearing on the papers, so if it goes ahead then you'll get a written judgment.

    If it goes ahead = depends on if the Claimant pays the hearing fee, which has the same deadline as the WS final submission day.

    Therefore, proceed as if the hearing will go ahead, and do a WS as registered keeper, relying on the facts that:

    • Prior to a year ago - and certainly in 2023 - Group Nexus chose never to use the Schedule 4 POFA wording,
    • therefore the keeper can't be held liable due to the Claimant's choice not to use the only law that can allow keeper liability, and
    • show time-stamped images of the disabled bays to prove that there are no t&cs signs in those bays and that the lines are faded and they look like the adjacent parent & child bays…*

    *go get some photos as we urged last year.

    @JackR1 (in an update posted this month, April 2026) includes a WS with HHJ Moloney's transcript as well as Edward, Smith, Wilkinson.

    You should attach all of those cases as exhibits along with your photos.
