Hi all,
I’m looking for advice on a claim Parking Eye is pursuing against me for allegedly breaching their parking terms and conditions.
I parked in a car park managed by Parking Eye and made payment at the machine provided on-site. I used Google Wallet to make the payment, and at the time, everything appeared to go through. However, about a week later, the payment was unexpectedly refunded to me (I didn’t know the money had been refunded at the time).
I explained this to Parking Eye and provided proof from my bank that I attempted to pay at the time, but they’ve insisted that I breached the terms by not completing payment.
We’ve now exchanged pleadings, and one of Parking Eye’s key arguments is that the proof of payment I submitted shows the transaction was made to “Residual Properties Ltd” and not Parking Eye.
I’ve made payments at this same location before, and the receipts on my banking app have always shown “Residual Properties Ltd” as the payee without issue. This seems to be how the system is set up. The machine I used was branded and operated by Parking Eye.
I know the court will decide based on evidence, and I’m unsure how to counter this argument that payment to Residual Properties Ltd is somehow invalid. I paid at the machine provided by Parking Eye in good faith. I don't want to be penalised for something that was beyond my control.
Has anyone dealt with something similar? Is there a legal argument I can use to show I took all reasonable steps to comply with the parking terms?

Have you received the letter of transfer to your local nominated civil court yet ? ( which court ? )
Keep a written record of all your transactions to that Residual Properties, plus the failed transaction and refund etc
Get pictures of the signage on that site, including the payment meter, especially if they are still the same as when the historic visits occurred
Meaning gather your evidence ASAP, ready for your future Witness statement plus Exhibits bundle

Meaning gather your evidence ASAP, ready for your future Witness statement plus Exhibits bundle - I had only attached a screenshot to my initial defence and WS. I assume I can amend (include more evidence per your suggestion) before the hearing?

OK, so you can add numerous pictures, statements etc to your future, detailed, WS bundle, plus a costs assessment document too ( study other recent WS bundles etc on here for pointers )
So yes, include your evidence to your local civil court and to parking eye at the WS deadline time, bearing in mind it could be months away
So Parking Eye added on the extra but spurious £25 as seen in other recent cases on here ( probably not mentioned on their signs, which is another good reason to get signage pictures )2 -
Can you replicate it by video?
Go back there, and using a second phone held by a passenger: firstly film the instructions and signs and then film yourself paying deliberately OVER the stated tariff by an extra penny (i.e. a unique sum like £1.01) on the app.
Then you can prove that the unique £1.01 transaction that you have on video, then genuinely comes out on your banking record as 'Residual Properties'.
Send that video link and app screenshot to PEye and robustly (...no please/thankyou nor 'kind regards') invite them to discontinue or you'll claim all your costs for their wholly unreasonable conduct AND you'll send your evidence to the MHCLG as part of your response to the current Public Consultation.
