Hi, first time user after advice. Followed 'ignore' advice (although missed Letter of Claim opportunity) on here and the registered keeper submitted Acknowledgement of Service on MCOL today. Putting together the defence utilising the template available. Are the following points relevant in any way?
When the initial NTK landed the registered keepers details were correct however since Debt Recovery Plus got involved the surname has become misspelt. Therefore the claim form is also misspelt, does this matter?
The location of the alleged residents parking is off a particular street with it's own address however the location given of the alleged parking charge is the actual street name. This street has no parking restrictions. The photos provided by Park Watch show it isn't parked on the street. Is this relevant to the defence statement?
bw legal have lumped together two claims, is there any specific advice for this situation?

You can correct the name on MCOL, especially if its only a minor mistake , no biggie
If its fairly obvious where they mean, it could be a moot point in court
Presumably its one single court claim for 2 PCN's
Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

Login to MCOL via your government gateway account and complete the AOS online if not already completed
Then start drafting your defence based on the template defence by coupon mad, adapting paragraphs 2 & 3
It helps if you read other recent B W Legal cases, for inspiration2 -
Yeah did the AOS yesterday and started adapting the template. I'll search the forum for bw legal inspiration. Can't even get the basics right like correct name spelling nor correct location. The registered keeper was unaware that the waste land was private, not parked there since. Signage is limited and dark at night.
Is the defence purely written and keep back evidential photos for court if needed? Cheers0 -

Definitely worth seeing it out because even if you lost, the extortion if 2x £70 as a supposed DRA 'fee' is unlikely to get past a canny judge.
If you want to be part of the push to change things in future, it's very important that people like you tell the Government that:
a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent and impartial (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN' (WHICH ONLY THE DUPED 14% OF VICTIMS PAY, AND SERVES NO 'LEGITIMATE INTEREST' BECAUSE BW LEGAL DON'T MAKE ANY MONEY IF THEY DO RIGHT BY CONSUMERS BY CONSIDERING DISPUTES PROPERLY).
c). Tell them about your experience and the complete and utter waste of court resources caused on a grand scale by firms like BW Legal.
