But on the letter it literally says if legal action is taken, then it increases to £280 from £170, from debt recovery plus.

They're offering to let me pay £10 before August then the rest within 30 days. The evidence smart parking uploaded just has me entering and leaving the road where they operate, shouldn't they need pictures of me actually parked up?

Should I share the PCN/car reg here?

    Share a copy of the PCN with your personal details blanked out.  A photo with a bit of paper over name, address, car reg should be fine.

    Escalating costs is how they scare people into paying.

    Court claims end up at about £250 - £290. But its moot because they discontinue 99% of the time. It's a game of chicken and by the sounds of it you're getting roped in by negotiating with their powerless debt collectors.

    Find me a Smart Parking thread where someone went to a court hearing in front of judge, lost and had to pay £250  :)

    Debt firms in this industry are merely trying to extract money from victims who don't realise that they'll pay nothing when defending a claim.

    Hi so this is the PCN. POPLA rejected it.





    The road between the 2 buildings is where the PCN company is operating their cameras, the building to the right has the parking company working for them (the PCN sign is on both sides, I was on the left side next to evri building, working for evri)

    In my appeal, i tried saying I was parked behind the evri building at the back circled in blue, they still rejected it, their evidence is just me entering and exiting. But in all honesty I was parked half on the cerb on the left between the 2 buildings on evri's side. I thought to let it go to court and argue this, but then what if they bring in full recording of where I parked.. Is the sign on Evri's side even legal? Considering they don't own that side? Isn't that pathway on Evri's side separate completely from the building on the right company who hired in the parking company anyway? Makes no sense why they're allowed to operate the parking fines for parking on the cerb that's next to a whole other business?

    I tried calling the company who brought in the parking company, they said they can't do anything?

    The regulars on here would not let that happen, and they have been helping people on here since 2008, you have just quoted one isolated case with no background.
    DR Plus are a no win no fee so called debt collector, engaged to send scary letter full of BS. I have ignored them nothing happened because like you I had no debt only a speculative invoice from a bunch of chancers
    If you had legitimate business on that industrial estate how are you supposed to get authorisation?
    What exactly have the scammers said you have been charged for (it is a parking charge not a "fine") that letter says nothing.
    You do not make up stories about what happened you tell the truth, though nothing you would have said would get the greedy scammers to cancel.
    I suspect you just told POPLA a story of what happened they are only interested in process, contracts, signage land owners contract etc. not mitigation.
    GSV is six years out of date but the signage then was non existent I suspect you parked along here, DYL's on private property are just pretty paint, they don't mean the same as public roads they can mean no Fords can park there if the scammer say so.

    Hi,

    Yes the road down there has signs up now saying no unauthorised parking and even parking spots on the right which say the company on the right's name "RS FOODS ONLY".. 

    You get authorisation to park there by being a RS foods employee and entering in your number plate.

    I've read the newbies thread but i have dyslexia all that text is daunting to be honest I'll re-read it when I'm back home later, and I'll probably just ask chatgpt to summarise it.

    The guy with the writ ignored a CLAIM FORM which you are not going to ignore. And a Writ is impossible in a single PCN case like yours!

    And DR Plus aren't solicitors. They can't sue.

    You'll get a court claim (in the end) from DCB Legal and after a year they'll discontinue. The PCN will die a death and there will be no hearing, no CCJ and no costs.

    As you lost at POPLA and are asking pertinent questions and seem to want to get to the bottom of everything, we hope want to be part of the push to change things in future?

    It's very important that people like you - let down by POPLA - join us to reply to the new Public Consultation, to tell the Government NOW that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 promised the public. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court. You wanted a fair ADR and did not get it.

    b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY A THIRD PARTY DEMANDING MORE MONEY AND OFFERING A POINTLESS 'PAYMENT PLAN'! 

    c). Tell them about your experience and that your case is now heading slowly to court stage, precisely because (a) and (b) above mean there is no option, no safeguard for consumers EXCEPT court claims, where DCB Legal will (as usual) feign to proceed, then they'll discontinue. Wasting everyone's time.
