Civil Enforcement - Court Claim 2025

Tell her she just needs follow post 2 of the NEWBIES thread which only needs her to respond at LBC stage, then claim form stage.
I hope you'll both take time in August to join us as we discuss plans for compelling responses to the consultation. We need the Government to hear from victims to hit home that making people pay any extra 'DRA fee' is a complete NO, even if it was £20. It doesn't work. It just funds & drives the third party CCJ seeking culture and makes people see court as the best option (which it currently is because there is no safeguard or buffer at pre-action stage).PRIVATE 'PCN'? Has this gone too far now for her to not let it go to court?Coupon-mad said:Tell her she just needs follow post 2 of the NEWBIES thread which only needs her to respond at LBC stage, then claim form stage.

Thank you for all your help. We will definitely be giving our voices0 -
If she cannot get the pcn cancelled by the pub or pub chain or brewery, then they are likely to issue a court claim against her using MCOL ( going to court is not inevitable, not the same thing as an initial court claim )
Reminds me of the following thread
https://forums.moneysavingexpert.com/discussion/6621488/civil-enforcement-pcn-and-lbc-time-frame#latest
I doubt that it will reach a hearing in court2 -
Got a quick question please. No point starting my own thread as I'm in exactly the same situation as the OP (just had a LBA from CE and I wasn't the driver).
@Coupon-mad you said above (on 24 Jul) that the RK shouldn't name the driver but should say the RK wasn't driving.
Later (on 31 Jul) you said the RK can still give driver's name & address if the driver has more fortitude to defend the claim.
Could you just clarify which of these 2 options is more advantageous at LBA stage. Sorry if I've misunderstood anything.0 -
Depends who'd be the more confident defendant to receive a claim form without pooping their pants and will happily copy our template defence and see it off.
It is easy but one of the two people might be more of a wuss than the other?! Only you know. I'm being honest, if tongue in cheek!
And if you want to be part of the push to change things in future, it's very important that people like you tell the Government that:
a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent and impartial (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY. WHAT EXACTLY DID CEL DO, TO JUSTIFY £170? NOTHING...
c). Tell them about your experience and the complete and utter waste of court resources caused on a grand scale by firms like this, who have little or no intention of reaching hearings.
Responses are invited to the Consultation now:

Do it this month pleeease! We will discuss it on that thread next week if you want ideas.
NO REPLIES HERE PLEASE.

Today we received a claim form from Civil Enforcement Limited. The Court Address is in Northampton we live in County Durham (North East of England)
Please advise the defence for my husband and should it be at a local court?
TIA0 -
Follow the advice in post 2 in the newbies sticky thread in announcements, plus the first 2 posts in the defence template thread in announcementsWork2live1 said:Today we received a claim form from Civil Enforcement Limited. Post the Issue date from the top right of the claim form below and also post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first
The claim did not come from a court address in Northampton, it's from the civil service business centre ( not a court, the court there is a different address )
Your defendant husband will nominate his local civil court later in the process, in a couple of months, although it will drag on for another 6 to 12 months before the final result is known
Are DCB LEGAL involved ? Or only CEL themselves ?
Please edit your thread title, removing Letter Before Action, and add court claim 2025 instead1 -
Sorry Im not savvy I do not know what POC or VRM means. DCB did send a letter at 1 point but on this letter just CEL on the claim form. Also do I respond with defend the claim and contest jurisdiction or just defend the claim?Gr1pr said:

Poc, Particulars of Claim, on the lower left of the claim form
VRM is Vehicle Registration Mark, the characters on what we incorrectly refer to as the number plate ( because Letters are also involved )
Follow the AOS advice in those announcements, to the letter
Yes the defendant defends the claim ( the defendant must do it )
Do not contest jurisdiction if in England or Wales
The defendant logs into their government gateway account and navigates to MCOL, then completes the AOS online
No paperwork is involved0 -
Of course you don't contest jurisdiction and of course you won't be going to the admin centre at Northampton.Work2live1 said:

Please just read the simple 8 steps in the Template Defence thread (which we won't link because it's at the top of the forum).
You also seem not to have yet read the Newbies FAQs thread either because you haven't familiarised yourself with the forum acronyms. Please read those two Announcement threads now.
This is very easy but you need to read sticky (pinned notices) threads first, before posting. If you don't know how to navigate the forum, my signature explains where to click vvvPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
