Did they really issue a "Penalty Charge Notice"?

See the template for paragraph 2

^^ADD 'and driver' if admitting that.

if you were not driving and believe the NTK was non-POFA, add that fact.

You should be truthful,  plus if the NTK PCN letter complied with POFA,  then add and driver if you were the driver,  especially because a known driver is a first person witness , your defence is a statement of truth

If Pofa2012 was complied with,  then a keeper/ driver argument is moot, read the following post

Not if you are using MCOL as is the current advice

Copy and paste the template,  removing the instructions about 2 and 3, edit 2, add your 3 , job done,  paste it into the MCOL defence box , save,  submit

Just follow the new advice as is
  • thank you @Gr1pr., your help is very much apprechiated.

I think that's putting Chan & Akande into the wrong place and it fails to make enough of the 2025 ban on the '5 minute rule'.

Para 3 should use the usual words about Chan and Akande to strike the case out.

Then an extra para 4 should be a about how long it took you to pay and why, and that you appealed and the Claimant rejected it outright. Copy the defence words you found when you searched for:

    Hannah Robinson wonders mine defendant

I PROMISE that search finds the paragraph to copy. Change to 'newest' and read more than just a handful of the first results. Read more of the results till you find a defence with the words you need about the 5 minute rule.

If by adding a para 4 and renumbering the rest, the template doesn't fit when you try to save it in the MCOL defence box, just delete the final paragraph about discontinuances / the White book. You can do the final adjustments without our help: make it fit.

Then hit SUBMIT defence. Don't just save it, or it is not in!

    Hi all,
I am about to send N180 complited form . Can someone help with email address? Or should I just upload it on MCOL ?

    Thanks
Just follow the first 8 steps in the Template Defence thread. It is explained there and all the CNBC emails are there too.

Top of the forum or very near.

Please also edit your thread title to say you have a court claim, saying which solicitors and which PPC. You can now edit posts and your thread title using the three dots above each reply/post you made. We can't cope with the lack of context in a thread called 'Hi'!

And this month, we need you!

PLEASE bookmark this thread below and do Public Consultation if you haven't done it yet. See this thread: -

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-8-weeks-from-11th-july-2025/p1

We need every poster to come back & complete this vital Consultation before the deadline! Just 2 weeks left but please don't rush it. You can do some then save it and come back to it as you have time.

We understand that you may need some pointers. It looks laborious, we get that.

Any questions on the Consultation please ask - on the dedicated thread - but I've covered up to question 20 already in that first post, openly telling everyone what I'm going to put and/or what sort of evidence you might wish to use for your response, if you agree with what we'll be saying from our experience.

Whilst your answers must of course be your own, there are vital points to safeguard motorists interests to make, that many people may not think of without our guidance because we see cases every day and we know the legal background. However, people like you have lived & breathed the intimidation, greed and unfairness first hand so your voice is needed!

Its 33 days from the issue date from the top right of the claim form,  by 4pm ,

so what was the issue date

and what date was the subsequent AOS completed online   ?

     2 crucial dates
Please answer the 2 questions above

Your court order from your local civil court tells you what to submit,  who to and what to include,  but the typical answers are

Compile your Witness Statement plus Exhibits bundle,  preferably as pdf documents

Attach to an email and send it to the claimant, CEL for an in house claim,   ( or their lawyers if they used lawyers  ?    ) , plus CC the local civil court that sent you the court order as well,  so one email,  with attachments,  2 destinations,  by the deadline explained in the court order

What was the issue date on the original N1SDT claim form,  which you received a few months ago,  is what I asked  ( it definitely was not 15th September  , more likely to be June   )

The template defence thread is right at the very top of this parking forum
