  • I thought the discontinuation only comes after the WS has been submitted and also the WS deadline is 6 weeks before the hearing fee due date too
    That's annoying but they will discontinue. Show us the NoD (not the covering email) when you get it!
    so should i just wait now to receive the NoD or should i be making the WS. I'm a bit confused at the moment. thanks!

    OK, so they are checking if both sides are serious, because it requires both sides to submit their WS bundles first,  only then will they allow the hearing fee to be paid later, and both breakpoints must be met before any hearing date is inked in as being required in January 

    So as far as the claimant is concerned,  it's put up or shut up,  twice over, if they want an actual hearing next year 

    As for the defendant,  they MUST COMPLY with the court order,  by submitting their WS bundle by the November date,  to the court and to the lawyers as well 
  • how likely am I to receive a discontinuation before submitting a WS?

    It can the be day before exchange of witness statements.

    But late discontinuations are risky for them because they are vulnerable to unreasonable behaviour costs.

    In this situation, we KNOW they're going to discontinue, so I would submit your witness statement ASAP, with a costs assessment (£24 per hour).

    Travel to the site to take photos of the contract they are basing their claim on. That would be 45p a mile, plus an hour to sort out the photos.

    They'll be on the back foot when you've already done the work, and included a bill for eighty or ninety quid. The judge's timetable is designed to help you - he/she knows it'll be discontinued too.

    Or you could just leave it and submit on the 10th November if you wanted a quieter life.

    the site closed down around 4-5 years ago and they built an apartment complex over it recently but i can't find any images of the parking sign/machine online prior to that.

    The amount of time i have spent on this forum viewing other threads to try and get a better understanding of the whole process has completely fried my brain to the point where i am happy to pay the fee they have emailed me to settle as i just want this off my back. 
  • i know this will come as a disappointment but i want to thank everyone for their input as you have helped me get this amount reduced by 82% which i will probably pay today, as the settlement email DCB sent me expires tomorrow. in the email they mention if I'm agreeable  to this offer i need to confirm within 7 days so does that mean i don't just pay in the amount to their client account with the reference they have provided but i would also need to email them to confirm i have agreed this otherwise they can still claim the full amount?

    AS above(s) -  can you remind us what heinous crime has been committed that the claimant is willing to reduce the amount by 82%?.
