G24 small claims

Can be as short as one sentence and hanging up if you like.
"My offer to the Claimant is zero and I am looking forward to the hearing. Goodbye."
There are no marks out of ten, only a note to the judge that you participated in mediation. Or, like 75% of people, didn't.3 -
You are NOT getting sucked into being told to summarise your defence. Laugh when the Mediator parrots that the Claimant says your defence is "an internet template"!
In fact, get angry about the crap the Mediators believe and repeat in support of these Claimants. It is a farce.
Tell the Mediator their service is being duped by parking firm representatives and surely SOMEONE is noticing that all these claims get discontinued later? Is nobody joining up any dots here?! Say whatever you want.
The Mediation service is propping up a scam.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

so i have received the letter confirming the hearing (please let me know if i should upload this but I'm guessing they are all the same) and i have also had missed calls from DCB legal trying to settle the case as they have now emailed me an offer to settle (i would be lying if i said i wasnt slightly tempted to accept it to guarantee not having to go to a hearing as it is a small fraction of the initial amount they wanted).
Is the next stage to compile my ws as per the defence template and send this off to dcb and the courts
thanks!0 -
Do not use the defence template for a WS
If you received the court order, make a note of the hearing date, the WS deadline date and the hearing fee due date
A WS goes in after the fee date if they paid the fee, otherwise keep checking for a discontinuation, usually by email2 -
Desperate last minute calls and offers are usually what they do just before they discontinue.3
-
I thought the discontinuation only comes after the WS has been submitted and also the WS deadline is 6 weeks before the hearing fee due date too0
-
You have the court order, so you know the date order
But as I mentioned earlier, the N279 typically precedes the hearing fee deadline, not the WS deadline, unless the court orders it to be WS before the hearing date is decided
In most cases my earlier statement is correct, but you haven't shown us your redacted court order, so we wouldn't know !
Some courts are starting to require WS first, before a hearing date is decided later, if at all, IR under the pilot scheme of non attendance, like Manchester for example, it's a papers only hearing so in those cases the WS may be required, then the hearing fee paid, or the case will be binned
Your court order tells you exactly what the order is, with deadlines, so follow the order, it's not a choice, because its an order, like in the military3 -
That's annoying but they will discontinue. Show us the NoD (not the covering email) when you get it!Humble_in_the_Jungle said:I thought the discontinuation only comes after the WS has been submitted and also the WS deadline is 6 weeks before the hearing fee due date tooPRIVATE 'PCN'?
