G24 small claims

Hi,

I received a county court claim from g24 ltd in april this year for a parking charge from June 2019 to which i replied in the post with:

Dear Court Manager,

I am writing in reference to the above Claim M******, which i understand has been issued against me in connection with an alleged unpaid parking charge.

i wish to formally dispute this claim on the basis that i have not received any parking notice or any correspondence informing me of this charge. had i received any such notice, i would have responded promptly and settled the charge with the specified period.

i respectfully request that this claim be set aside and that i be allowed a fair opportunity to resolve the matter.

i would also request that all documentation relating to the alleged offence be shared with me, including any evidence.

regards

i wonder at this point if there is any point of filling out the 'Notice of Proposed Allocation to the small Claims Track" questionnaire and chancing my luck or should i just pay the £339 they are claiming i owe them to avoid having to pay even more if i were to go to court and lose.

Thanks greatly.

Whilst that is a very weak defence, if this is DCB Legal then they'll discontinue when you submit a decent Witness Statement.

    Absolutely NO PAYING.

You could offer a tenner at mediation phone call stage which sometimes shuts them up.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It may be that the allocating judge insists that a proper defence is filed sometime after the initial stages

Which legal company   ?  DCB Legal or Moorside Legal   ?

thank you! yes it is DCB legal.

would you be able to suggest what would suffice in a decent witness statement to put in the n180 form as i have a week to post it to the court (and i assume DCB as it states to serve all other parties)

The witness statement is submitted in several months time,  not at the N180 stage

The N180 is emailed to both parties,  not posted

    DCB Legal.

forgive me for sounding baffled but do you mean the judge is likely to disregard any subsequent witness statement and go off my lousy initial defence?

I mean that an allocating judge ( not the final judge  ) may order a new defence to be filed,  before any WS or hearing  ( meaning that they would bin your lousy defence and order you to file a new defence  )

You need to read the red heading section IMPORTANT: KNOW WHAT HAPPENS WHEN in the Newbies thread.

And the first 12 steps in the Template Defence thread, too.
