I’ve searched, but can only find a case where the defendant didn’t receive a claim. I’ve sent copied to doubledotcom to assist with a group complaint.Coupon-mad said:You did nothing wrong.
Just read the other threads like it (this is all too common) and send a complaint attaching your defence and the acknowledgement email to the CNBC headed UNPROCESSED DEFENCE COMPLAINT and the Claim number.
Also email a separate complaint to HMCTS as they will push the complaint through on your behalf.
You can find other threads like it by search the forum for:
complain CNBC all too common
or
Judgment default defence
...always change searches to 'newest'.
Please could you clarify - you say to email a separate complaint to HMCTS. I see there’s an online form. Should I use this? https://hmcts-complaint-form-eng.form.service.justice.gov.uk/yourcomplaintI don’t see how I could attach the defence using this process. Is there anything particular I should state, and ensure I don’t miss, to the HMCTS?0 -
That's very odd.Scubanutta said:

Send scans of your letters to @doubledotcom who is collating data for a major complaint to HMCTS. Include a declaration of what you received. See this post: -

The judgement has finally been set aside, after much toing and froing, and chasing HMCTS. The admin errors and lack of comprehension were frustrating, but we finally got a result. On the matter of compensation: I’ve asked what compensatory procedures are in place. The response I got was (with, I assume, an error in “correctly” supposed to be “incorrectly”) -
“- please advise what compensatory procedures are in place for matters of this kind
We're not in a position to offer compensation if the defence is found to have been filed correctly the judgment will be remove so will not exist anymore.”0 -
You can ask HMCTS to review the CNBC's handling of it. That might get an offer of compensation for time and distress.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. How should I contact them? I think the people who responded as above, about not being in a position to compensate, were the HMCTS. Is there another way to contact them to review the handling, other than via another complaint form?Coupon-mad said:You can ask HMCTS to review the CNBC's handling of it. I’ve read everything I’ve saved and bookmarked about completing the N180. I’m doing something wrong with the search function, because it gives me no results when I search N180.I’m aware that the advice is not to post asking about completing the form, but, in this case my partner is the defendant and I was the driver (not named). The overstay was whilst legitimately shopping, and the evidence is a hard copy receipt. Do I need to complete the form to include me (the driver) as a witness, to enable the receipt to be submitted as evidence?0

The N180 DQ document pdf stage is covered in the 8 steps in the defence template thread
But if you are dealing with a local civil court, email them and also the claimants lawyers
But
If you are following the 8 steps to deal with the CNBC, email the completed N180 DQ pdf document to the DQ email address and CC the lawyers too
As for the WItnesses number etc, just put 2 if 2 people are attending, or 3 if 3, they only need to know to decide on the size of the room ( large courtroom if 40 people are attending )3 -
Thank you for your quick response. I’m not sure whether it’s necessary to be a witness myself, or if my partner should attend alone, to present the evidence of the shopping receipt. That’s what I’m asking.Gr1pr said:The N180 DQ document pdf stage is covered in the 8 steps in the defence template thread

Is this “DQ” email address the same as the defence was sent to? My search doesn’t seem to be able to find anything I search for on here.0
