You won't establish any precedent and they probably won't proceed or pay the hearing fee.

I'm guessing they are not letting it go if they bothered responding to my defence.
Not correct. They always respond to court orders that don't require them to pay money because their template 'reply to defence' took them minutes to adapt and they are in the midst of playing a game with you, to see who blinks first!

They discontinue (in almost every case) before the hearing fee is due. Which AFAIK has not yet been ordered. No hearing date yet?
