Landowner refusing to intervene

I’ve had a PCN from UKCPS, they refused all appeals, I’ve ignored all further correspondence and now been issued with court claim via Moorside Legal. 

I’ve submitted my AOS via MCOL and need to prepare my defence before 14/5/25. In the meantime I’ve been focusing my attention on landowner complaint however they are saying there is nothing they can do to help as they can only intervene within 28 days of the charge?! I’ve said that’s not true and there’s thousands of cases where charges have been dropped after the landowner has instructed the PPC but not getting anywhere. I’ve reminded them the PPC is acting on their behalf and they have responsibility but again falling on deaf ears. Is there anything I can share with them to prove they can and should get this sorted? Share a link to the landowner thread with successful cases or is that a bad idea??

    You cannot force them to intervene only request, in fact his contract with the PPC may have a clause in it that he only has 28 days to request a cancellation who knows.

    You won't get it cancelled now it's at claim stage. Moorside / UKCPS cases are a cinch to defend though.

    Show us the POC, redacted in the same way as seen in all other claim threads near yours that you read.

    Oh - I’d seen cases on another thread of the landowner getting it cancelled even after court papers issued…

    Sorry what does POC stand for, just so I share the correct thing?

    Who is the landowner?
    Have you instructed them to tell their agents to discontinue the claim ? something that can be done upto the hearing

    Won't happen though - not the priority either - so the OP needs to do the right things.

    Possibly didn’t use those exact words but yes  - I asserted that they did have the authority to instruct UKCPS to ‘cancel the charge and proceedings’ (they are insisting there’s nothing they can do and just tell me to take it up with UKCPS or seek legal advice 😡)

    Housing development. Landowner is Strata Homes and Keepmoat. Neither have been helpful.

    You'd better getting them putting in writing why they think the charge is invalid, so you can use it in your witness statement.

    You may have to butter them up to get the words out of their mouths into an email.

    They are not the ones saying the charge is invalid? They are just avoiding any involvement or responsibility and say UKCPS have the authority to enforce charges as they see fit.
