Tenant wont pay rent to property management company

Hello

I have a property in London that I inherited in 2018. It has been a long ongoing saga. We have got to the point where the tenant no longer wishes to deal with the property management company but will only deal with me. I don't have the time or energy to deal with the issues that keep coming up, hence the property management. I don't have any complaints about them and feel that the tenant should go through their complaints procedure if she is not happy. Now the tenant wants to pay me and refuses to pay the PM company. I don't want this, has anyone got any suggestions about the best way to handle this please?

    The first questions are what issues? Are these to do with the property or that management company? If you really don't want the hassle then you could give them to option to find another tenant and they can walk. I don't see point in dealing with problem people, they always just going to be a pain.

    Have you had a new tenancy signed? If not, served S3 & s48 notices to tenant since inheriting?  If not you ain't fully landlord (S3) and no rent due (s48).

    If management company a lettings agent?

    Does tenancy agreement instruct tenant to deal with "management company".  Done any training in how to be a landlord?

    Who to pay is an odd deal breaker.. its really not that hard for you to receive the money by standing order vs the agent, and if they've been paying regularly and on time then it probably doesn't need close monitoring every month.

    Surely the bigger issue is who the contact when there's a repair issue.. given that can be middle of the night / inconvenient times and require more liaising. Are they contacting the agent for that?

    Get the tenant to pay to your bank account and pay the managment fees yourself to.the managing company

    Alternatively, change management company

    I think and OP please confirm, the issue is that the management company should be responsible for dealing with the tenant and the hole point is that the landlord should not need to deal with the tenants day to day issues, rather than simply who pays who.

    Hello, for the last 4 years the tenant has been paying the management company but there has been a falling out and now she doesn't want to deal with them. The falling out was around maintenance and expectations of the tenant. The tenant promised to buy the house in 2024 but that did not happen.

    Were the S3 and S48 notices issued as queried by artful? Have all the other issues like EIRC and gas certificate been complied with?  Ask the management company to provide you with copies and take advice from an independent person as to whether there is full compliance with the law.

    Is this a fixed term or rolling contract?

    Find out what the maintenance issue is? Is that something that would derail eviction? Is the complaint justified? If so, it needs resolving. Get the agency to do that, not you, but keep on top if it.

    If not just evict. Your are running a business and you have a difficult client on whom you are expending too much time and energy to justify continuing the relationship.

    They are both a letting agent and a management company, they found the tenant.

    S48 and S3 have been issued and the tenant is painfully aware of who the landlord is

    Why does the tenant not want to deal with the managing agent? How bad is the managing agent?

    I'd be looking at that first and see if you can solve the problem. Either by getting the agent to fix whatever problem is involved of finding a better agent.
