These days mediation is compulsory, so that might be the better option, nobody can tell you which is best, but one is voluntary, the other is compulsory since last year
This is an example of the latter

2) How likely is it that they will take this to court?
2) highly likely
Follow the wise advice already given in this thread, dont try to wriggle away, deal with it as described by coupon mad above. You wont find alternatives, so stop looking4 -
Defend the claim then await mediation! Easy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, you need to put in a decent defence, so use the template (but without admitting any liability) and bluff at mediation that you're happy to go to hearing. Otherwise you'll end up settling at £200 instead of £60-£100.3

Or alternatively
Defend the case, then negotiate a settlement at the compulsory mediation stage in a few weeks time
Contact the litigation team at Parking Eye and negotiate a settlement, perhaps between £50 and say £1201 -
You have every right to defend the claim. Claims like this are routinely struck out due to bad particulars and claiming excessive amounts. For example, how can they ask for £125 and rely on POFA 2012?
Defending the claim is not about just the contract itself, its also about parking eye complying with legal requirements to bring the claim and this is where the claim fails.
They will definitely settle at mediation because the claim will likely be struck out if defended properly.2 -
