DCB LEGAL SOLICITORS LEGAL REMINDER

I have looked through the forums and read some of the NEWBIE thread but as its from 2013 and long I just wanted to confirm what to do next. SO if someone could help me it would be greatly appreciated. I have been sent a solicitors reminder letter for a parking charge issues at a hospital for not parking inside a bay (I parked curbside where there were no double yellows). Also the car park is free and not pay and display but i have a charge now for £170!. I appealed to the company who said they did not receive either of my appeal letters. I withheld my name and sent the appeal letter via email and they requested signed consent from the keeper of the vehicle to converse with the email address I sent back from. I sent this back and it has been passed on to debt collectors regardless. Now it has found its way to DCB legal. 

I saw that I should appeal to PALs, but Im not sure how to go about this. Any help would be much appreciated. Irony is I am not even the registered keeper of that vehicle anymore!

    The newbies thread was started 12 years ago but is regularly updated by the author,  so follow the advice in there

    Not having the vehicle anymore is irrelevant,  sorry, it was yours at the time 

    Email the response template to DCB Legal 

    By all means complain   ( not appeal   ) to PALS , by contacting PALS at the hospital,  or direct to the trust themselves 

    I presume that the Parking company is Parking Eye   ?

    Thanks, there is just a large amount of information there and I was a bit overwhelmed by it all.

    No the company was called PCN I believe. 

    From what I can see I don't need to reply until I get a letter of claim?

    They havent been contacted by the company who administers the car park but by Direct Collection Balliffs.. who are also DCB, who are under instruction for PCN.

    They are the second debt collection company to contact me.

    Are they allowed to just flat ignore an appeal without rejecting or acknowledging it?

    Really dont want to have to go to court

    Not sure that PCN is correct,  the debt collectors letters tell you the name of the actual client , the car park company involved 

    I dont know the actual correct name of the parking company,  so cannot comment on the case itself,  too little actual information,  we dont even know the name of the hospital or any tangible facts yet 

    Nobody wants a court case, but its not your choice to make,  its up to the parking company

    The company is PCN (nw) Ltd and it was at Whitegate drive health centre blackpool. The landowner is Eric Wright and not the NHS trust apparently, so I will try and contact them to complain

    Did you appeal in writing ( not by phone   ) to PCN (NW ) as required on the pcn itself,  sticking to the rules listed in the IPC CoP   ?  ( Code of Practice   )  ?


    Plus you say its not a trust,  but a health centre,  so probably no PALS either , but the following link mentions the NHS , Blackpool trust and PALS too

    Try a written complaint to the practice manager Of the Health Centre , or PALS, or both


    I presume that the pcn was issued due to parking on a private roadway,  instead of using a bay   ?

    It was an emergency appointment and the bays were full and I parked curbside in the car park. There was ample room and nothing obstructed. I appealed  post twice ( they just didnt acknowledge either letter). I then created an email address and emailed the appeal. they requested a signed consent from the registered keeper which I did. they then added they needed something else on the signed consent which I did and sent over. They just flat ignored it, didnt even tell me the appeal had been seen or rejected before passing on to two different debt collectors and now its with DCB legal. I ahve spoken with health centre and complained directly to the landowner who is Eric Wrights construction.

    Is it worth complaining to the practice manager as well

    The website mentions the trust,  so complain about it to both the practice manager and to PALS

    I doubt that a construction company is the landowner,  but may have been if it was a recent construction,  or they were the contractor,  so no problem in complaining to them too, the more the merrier

    Then dont pay it, just follow the advice given here in the newbies sticky thread in announcements,  plus if you get a court claim follow the same advice,  plus the advice in the defence template thread as well seeking our help and advice by continuing in this thread 

    A claim might happen,  but court is not inevitable,  you are a long way away from any courtroom 

    But ideally you raise enough complaints to get it cancelled ASAP,  plan
