    One way to look at this.

    OP son wants a car. Which they need now.
    Garage is going to stand their ground & not budge on the offer.
    OP son can't really go & buy another car if they go to court. Which @ best will be months. Due to possible change of mind by garage. If they did & OP says, well tough we have bought another car. Garage can counter sue for loss of value on car they were going to buy.

    One thing to be right, expending time & effort, another to take the practical approach & save yourself a lot of trouble. Simply walk away & go elsewhere.

    I took it to be that OP's son needs the car for September, so they have time to search for a different car, or they might take their chances with court in the hope they get an early hearing.

    Like you, I think walking away is the right choice here.  It may even provoke a more helpful response from the dealer.
