If the facts are as stated than the op and garage had a contract and the garage cannot just simply walk away from it.

That said the courts are unlikely to enforce specific performance ie insist the contract goes ahead

What the op can claim for against the garage is any financial loss the op suffers as a result of them cancelling the contract.

@SaverRate, The intervals have changed from 4 years to 5 to 6..... Unfortunately I have experience of one going and writing off the engine! The main dealer eventually paid for it as it was under warranty.

My issue that they have gone back on the agreement and cost my son £600 to £800!
Most VAG cam belt intervals were 5 years but have now been changed to lifetime or 150000 miles I think
    This is correct.

@sheramber, I brought it up as a condition to buy the car as they couldn't confirm that it had been done since new. They initially said it should be done after 6 years (hence they would check and replace if it hadn't been done) but now suggest there isn't an interval!? They sorted the scratches and confirmed the window screen was ok, just back tracked on the cam belt.
Given that the cam belt is now lifetime they are unlikely to budge on changing it.

Have you asked for refund instead

Whether it needs changing or not is irrelevant.  It was an agreed condition of sale the belt was changed, if the seller is now saying it won't be the buyer can walk away with a full refund.

Forcing the garage to do the work isn't worth the fight.

Sounds like a typical salesman promising anything to get a sale, then his manager/service manager telling him not to be stupid. On quite a large cost item, they are not changing the belt. Get a refund and continue your car search with a bit more knowledge on salesmen and cam belts.

But the OP says they have the confirmation in writing in an email. The wording has been asked for but not yet supplied.

So what, my comment still applies, email or no email.

    Weird response, but ok.

You can ask for your deposit back. If you subsequently find another deal elsewhere which is more expensive, they will need to compensate you for the "loss of deal".
  • @Aylesbury_Duck, Yes I would like the dealer to stick with the original deal and for my son not to have to pay out for the replacement cambelt.  Reading the comments, it sounds like the small claims court is my next option.

I really cannot understand that they are not worried about their reputation. This is my sons first car, who lives a mile away from the dealer, starting a new career and will be buying new cars in the future. The 'ripples' of going back on their word will cost them a lot more than the cam belt!
