 Hi all,


I urgently need help regarding three separate parking charge claims, especially as I’ve now discovered that court proceedings have already started for two of them — and I haven’t submitted anything in response yet.



Overview:



  • I just received a Letter of Claim dated 4th April, but only became aware of it today (25th April). As per the letter, service is deemed five working days after issue, meaning around 11th April, so I’m likely outside the 14-day response window.
  • The delay is because I no longer live at the address the letters were sent to. The current tenants only just forwarded the latest letter to me.




More critically:



  • I had previously received two other Letters of Claim dated 19th March.
  • Based on advice from another forum, I checked the MoneyClaim Online website and discovered that court claims were issued on 8th April for both of those earlier cases.
  • For further information, I have not responded to any of the claims — no Acknowledgement of Service (AOS) or Defence has been submitted at all.




My Questions:



  1. What are my immediate options for the two court claims already issued (dated 8th April)?
  2. Am I too late to respond, and is default judgment now likely?
  3. Can I take any steps to stop or delay these proceedings, given the address change and the fact I only just received the letters?
  4. Is it still worth responding to the third Letter of Claim (dated 4th April) or am I already out of time?
  5. Should I now notify the court of my current address and request to have any future hearings transferred to my local court?



This situation has become overwhelming, and I want to act quickly to avoid things escalating further. I would really appreciate any guidance on how to proceed with all three claims.

    Do the AOS immediately for both claims Put your new address on the AOS. That automatically updates the court address sytem. Then do the defence over the weekend.
    Other stuff can wait like informing the claimaint of your new address can wait.

    Login to MCOL and complete the AOS online and add a cut down version of the defence template into the start defence box,  especially if more than 19 days have elapsed since the issue date on the top right of the claim form,  because if the claimants haven't pulled the trigger yet, you have to beat them to it, like this one

    Also inform the claimant parking company and the CNBC and any lawyers of your correct address for the service of papers too

    If you are within the time limits, do just the AOS online in order to get time to deal with it over the weekend as chirpy chicken mentioned above 

    Yes you can and should email the LoC template response to the recent letter of claim

    Handle the claims first:

    How to do the AOS is shown in pictures in a Dropbox link clearly stated in the 2nd post of the Newbies Thread. Easy.

    You are still in time this week to Acknowledge these two claims - have you obtained them both from your old address? Show us the 2 claims (redacted, and redact Claim no & MCOL password):

    Dont log the defence until next week as you need to AOS to be received and processed in order for the address change to happen.
    If you do the defence first this wont happen and it will cause more issues

    As it seems like you are still within the 19 days allowed  ( not 14 days  ) ,  do the AOS only for now and work on them over the coming weekend or week

    You should have done it the other day so yes immediately stop hanging around.  You don't need to ask if you should do it today when you were told on the 25th to do it straight away.

    And dont wait around for notifications,  just get on with it  ! ( all the advice you need is already on here , in announcements  )

    You can't wait for notifications. You are defending a claim! Stick around daily.

    Just read the forum daily, like we do (not your own thread only, please, drives us mad when posters just pilot in occasionally to their own tiny thread like it's something new & different when they could have found the answer in ten minutes by skim reading a few threads next to theirs that day).

    What you are doing will save you hundreds but is time limited. We want to help.
