A user has posted their defence here:
    https://forums.moneysavingexpert.com/discussion/comment/81544284/#Comment_81544284

It is very similar, just shorter but fits MCOL apparently.  I don't think anyone has verified this is OK as an adaptation of the original from CouponMad.  Is the above defence good enough?  I need to submit mine tomorrow at the latest as I go on holiday.

Also I was told my 3.1 paragraph was to wordy.  Is this OK or too brief?

"The Defendant rested his car in the car park for a short while and did not leave the vehicle. No signage was seen or was visible. It is maintained that no valid contract was offered and there is no contractual relationship between the two parties.  The defendant has photographic evidence that the signage was not visible as it pointed away from the defendants direction of travel and is impossible to see on approach and on entry to the car park."

    Thanks
That looks fine. But the Template Defence has been up and usable for ten days now anyway so there was no need to look on other threads for alternatives.

Anyway I assume you've submitted it?

Your important 'job' in July/August is now this:

It's very important that people like you tell the Government that you have no faith in the parking industry and the DRA demands are a pathetic attempt to extort money.

It's cheaper and far better to defend a court claim and third parties adding any extra money is one of the major two factors that stop people engaging at pre-action stage (the other factor is using old addresses and refusing to reissue PCNs or hear disputes).

THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED.

DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND ENGINEERING A 'PAYMENT PLAN'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Fourth Anniversary First Post
I’ve had similar, mine is dated from august 2020, I remember the location as it was the last year we took our choccie lab Charlie to the beach in Cornwall. Paid for the parking etc.. this is the first we’ve heard about it and don’t even own the car anymore.

ill be waiting for the summons and pop to court to contest the matter, currently my daily rate or part daily rate is £660 plus vat and expenses….

ill let you know how I get on.

5 years is ridiculous time…I’m not even sure if I have records of the payment for the parking as I’ve not taken this seriously. All the usual threatening paragraphs and the can’t pay well take it away emblazoned in the footer of the letter

for people with no experience of the courts this must be a terrifying experience

I've posted about the Public Consultation on your thread too. Please do join us in August as we work out strategy and ideas for responses.

Or - better, because we don't want copied template responses - do your own response in your own words, as long as you say:

    (i) that DRA fees must be banned as they are extorting money from the public for a dubious (anti-consumer ethics) bullying service that the industry should pay for, and

(ii) that there MUST be a properly impartial non-industry influenced Single Appeals Service to replace the two joke 'appeals' run by the trade bodies that seem to be in a race to the bottom.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hello all,

    From the MCOL website:

Your defence was submitted on 18/07/2025 at 22:50:34

Your defence was received on 21/07/2025 at 01:05:35

28 days was the 25/08/25.  Does the 28 days start from my submission or will MCOL have taken a few days to send on to the Claimant?  I'm worried things might have got lost in the post and I'm aware strict deadlines to reply etc apply.

    Thanks

No worries. It is safe to wait at this stage.

    Just a reminder for us:

    "Brief/concise summary:

July 2024 - PCN from Parking Group (The Parking People)
August 2024 - Appeal submitted (Parking Group Website) - screenshot saved as proof of submission

    HEARD NOTHING BACK

October 2024 - Letter from DCBL
October 2024 - Letter sent to the Parking People informing them that my appeal received no response and that they had denied me having my appeal heard by POPLA.  I asked for a new appeal rejection letter and a POPLA code.

    HEARD NOTHING BACK"

If its in, it's in, nothing to worry about

The case will progress as normal,  probably slowly,  but you can keep checking your MCOL claim history for any progress,  for the foreseeable future
