    Is there any risk of the CCJ sticking if this complaint runs over the month deadline?

    Could they say it myb fault as I sent scanned images and just reject my appeal/complaint leaving me with a CCJ?

    I did explain that you should study other recent cases, but you don't appear to be following my advice  ( instead you are asking question after question. )

    I need to act swiftly to avoid a CCJ but am now questioning if it is worth the gamble to pay £313 to try and have the judgement set aside.
    You aren't doing an application.

    You aren't paying £313.

    You will temporarily see a CCJ but it will be reversed because you can prove you sent the DQ (we wish you hadn't scanned it though. The advice in the '8 steps' is to download it).

    Just copy what others did and also email a separate complaint to HMCTS ... like everyone else does in these cases. Read some threads and copy how others resolved this crap. Do it asap this week.

    Who do I email?  dq.cnbc@justice.gov.uk?  I can't find a template anywhere.  Is there one for my situation?

    Thanks everyone - I complained and had the judgement set aside. They have allowed me to submitt another N180 which I have done. I have received notification of my mediation telephone appointment 10th March. I will be at work during the 3h time slot. I teach so can't just be available when they ring. I'll have to request cover for my lessons. How long is an average call? Also any final tips for this call? To attend a hearing would be unpaid leave so I would lose at least half a day possibly a full day which after tax is approx £220 So I'm torn: Assuming a day off work, I'm £220 out of pocket and potentially another £300 ish on top of that if I lose. On the other hand they may discontinue. Part of me also would like to see the process through so if this happens again I am familiar with the whole process. If they offered me £50 for all this to go away I would be tempted but then surely this means they don't think they have a solid case at a hearing?

    Reminder: I have photo evidence of signage on entry to the carpark facing AWAY from my direction of travel. Yes there are signs on a brick wall inside but I never noticed these and have taken photos from my car and you would have to be very close and looking for them to read them clearly. From a moving car they are unreadable.

    Does anyone have any legal wording I can quote to the mediator? To do with no contract being formed due to signage?

    Why are you asking for legal wording when the first 8 steps (in the Template Defence thread) tells you about the Mediation call and tells you what to say?

    It'll take two minutes flat. You certainly don't explain your defence to a clueless (third party non legally trained young pen-pusher) 'Mediator' who isn't a judge and whose entire job is to pressure you to fold.

    No offer. Goodbye! End of call.

    If you answer at all, which you don't have to.

    There won't be a hearing.

    DCB Legal will (not 'may') discontinue before they have to pay the hearing fee. Trust us! 780 examples here, and counting! Think of this as a simple form of dispute resolution where they will blink first because that's their business model.

    Sorry if I have misunderstood but I read somewhere that if you did not complete the mediation process the judge may just rule against you?
