UNiversalk Credit : if asessed as unfit for work

MY WCA is due next week.

At the moment, my Work Coach has agreed with me that I have  Limited Capability for Work.

Right now, I am really struggling and feel barely capable of any work, but I am hoping to carry on as I don't want to stop work.

I was wondering what the financial implications would be of being declared unfit for all work. Would I get less money? More money? The same? What would happen?

If you get assessed under UC that you have LCWRA then you get a £423.27 a month on top of your std UC

If you are found to have Limited Capability for Work, no extra money is paid.

If you are found to have Limited Capability for Work & Work-Related Activity, an extra £423.27 a month would be paid.

For either you would have a work allowance on your claim. This is the amount of money you can earn before UC make the standard deduction of £0.55p for each £1 earned.

If you claim Housing Element the amount is £411.

If no HE then the amount is £684.
  • If you’re working and you get found to have LCW or LCWRA I think the amount you’re allowed to work will be limited.

You can work if on LCW or LCWRA without limits.
You just have to be careful your job doesn't contradict how you qualify for LCW/LCWRA, as it would potentially count against you at the next review.

I would go a bit further than that, if someone's work contradicts their WCA then that would need to be reported.

When you state your work capability is due, have you previously had one? Are you on universal credit currently or legacy benefits?

    What makes you think that?

That's not the case at all and it would be useful to know exactly what misconception needs putting right so that you understand why there are no work limits on people with LCW/RA.

    Thanks for the replies.

So, LCWRA basically means you cannot do any work? Or is there a third category along with LCW and LCWRA about this?

LCWRA means you are not expected to do any work or work-related activity.

LCW means you're not expected to work but you are expected to do work-related activity which will likely mean attending appointments, but they are supposed to take your circumstances into consideration.

However you are allowed to work.  If you find some suitable form of work that you can do with your abilities and health restrictions, there are no limits on how many hours you can do or how much you can earn.  You also get to keep the first £411 or £684 of what you earn each month before they start taking deductions (whereas people without LCW/RA or dependant children have the 55% deduction taken for everything they earn).
