Scs sofas manufacturers defect

Just looking for a bit of advice so i brought 3 3 seater leather sofas in 2021 and were delivered end of 2021, around the beginning of 2023 i notice were you sit on the side of the cushion they used vinyl leather so the vinyl started breaking. 

I rang scs and they told me to speak to castalan as your still under gurentee so i spoke to them and semt pics and they told me its a manufacturing defect and they won't come out and speak to scs again.

So i rang scs and told them what castalan said and they told me that i have to pay 70 for a independent company (emiera) to come down and if its a manufacturing fault then it would be included in the price to fix the sofas.

Me at the time was not happy to pay a further £70 as i had the same problem before i wemt to scs with dfs were they were breaking in the same place with dfs so i knew it was a manufacturing fault and i ended up taking my case to ombudsman and got a full refund with dfs.

So i got in contact with ombudsman again and they told me i have to pay that 70 so i did and then emeria came out to assess the sofa a month ago and confimed its a manufacturing defect and they cant fix it and told to ring scs again.

I rang scs and as they had the report, they said we no longer have thouse parts and gave me 3 options either keep the sofas as they are and we refund 600 or we can give the sofas back to the value of 1215 which is 60% of the price i paid.

I paid around 1500 for the 3 3 seaters sofas and 500 extra for leather protection guarantee so around 2k altogather.

I really like the sofas and would rather keep them but i am annoyed i paid 500 for no reason as they have not fixed my sofas on top of that i have paid £70 for a independent assessment which they said that £70 will include parts and labour to fix the sofas

So im now in a situation i have paid like 570 for no reason and they are only offering 600 so basically only £30 for the manufacturing defect, i did ring scs and told them that £600 is basically nothing considering i paid 570 for basically nothing and they have uped the price to 800.

So was woundering what are my rights on the manufacturing defect as i would rather scs fix the sofas if not they should be offering a full refund or replacement.

Any advice will be highly appreciated

    Your rights are that after you’ve proved it is a manufacturer defect then THEY can choose to repair, replace or offer a partial refund based on how long you’ve had them. 

    So if they’ve offered 60% for 3.5 year old sofas, I would bite their hands off. That would give and estimated lifespan of about ten years. Most retailers choose six , so I think they’ve been generous. 
  • OP what does the guarantee say about what happens if the sofa can’t be fixed? 

    If it doesn’t say anything I’d be wanting my £500 back on top of what offer you decide to accept.

    I don't think it's a guarantee, it sounds like accidental damage and staining cover (which wouldn't cover a manufacturer defect) See second paragraph.

    Thanks :) if it’s a separate kind of cover to the issue OP has I’d look to claim back the unused time left on the cover instead.

    I am more then happy to keep the sofas as they still in good condition apart from the vinyl breaking so i would really prefer a repair but they do not have the parts anymore but i dont think that's my problem as i paid for the warranty for 5 years so i think they should eva repair or offer a full refund considering the fault was there when i brought the sofas as when i purchased from scs i told them what had happen before when i brought from dfs and they just turned around and said we are scs not dfs we use real leather and then i had the same thing happened with scs in exactly the same places as dfs.

    You are not going to get a full refund, you have had two years of use and also say you are  happy to keep and use them!

    I am happy to keep them if they repair them, i don't think its fair that i paid nearly 500 for the warranty and another 75 quid for repairs and i ent getting any repairs done at all, so that should be included in any price i am offered no.

    You paid nearly £600 for repairs if you need any but when the time comes you cannot get any repairs because parts are not available, so what was the point me paying 600 is what i am saying.

     Mentions a £75 call out fee 10.2 after 12 months.

    You don't get back extra you paid for warranty. You had to choice not to take that extra.
