DCB Legal LTD Brocklebank Retail Park

I've recieved the usual claim form, have done the AOS and am now at writing the defence stage.

This is for "overstay" using Greenwich retail park. I was unaware that there was a time limit if you were a customer of the businesses there until I received the fine. I didn't notice the time limit on the signs there or I would have moved/left.

Can some one help me word that in a better way for section 3. of my defence? Is it worth including at all?

Nope. You don't have any 'fine'.

Please just use what I already link there which already gives you your para 3.

    Show us the POC please.

And in future,  please complain about any future pcn invoice from a private parking company to the retail park management company or landlord,  or even the retailer or business,  ASAP after receiving it, as explained in this thread below

But do follow the advice given above for the current court claim

    Hi all, quick update.

My DQ was somehow "misplaced" even though I sent it via email. I've sorted that now and resent yesterday. Today I've received a mediation phonecall appointment out of nowhere. I checked the form and it seems like mediation is mandatory now?

Either way, I also repeatedly mentioned on my form that I'm deaf and can't receive calls. The email about the mediation is no reply and only has a phone number for rearranging the booking.

I'm going to try to reply to the person who handled my DQ form.

Any other advice? Why have I received this appointment?

Compulsory mediation has been in force since summer 2024, the 8 steps mention it in the defence template thread in announcements near the top of the forum by coupon mad

That is why you received the appointment and they will phone you

No point in complaining about it to the CNBC,  it's a Compulsory step and was in force for some 9 months before you came here in April

I strongly suggest that you study the 8 steps,  plus the mediation service advice on here,  plus read a dozen feedback posts regarding the mediation phone call

You can get someone else to take the call or just ignore it. Mediation can be missed - no sanction.

    Small Claims Mediation Service
If you have any complaints or issues to raise about the Mediation Service
    Email:  scmreferrals@justice.gov.uk

You can use this email contact to tell them  you'd repeatedly mentioned on the form that you're deaf and can't receive calls.

Thank you for your helpful response. I would like to ignore it if there's no repercussions for doing so. I live alone so have no one to take the call for me at that time. Hiring an interpreter would be too costly as well.
