Thank you also for this very helpful information! I'll get an email off straight away and hopefully they'll be understanding of the situation.Nellymoser said:Small Claims Mediation ServiceIf you have any complaints or issues to raise about the Mediation ServiceEmail: scmreferrals@justice.gov.uk
You can use this email contact to tell them you'd repeatedly mentioned on the form that you're deaf and can't receive calls.
Thanks again for all the help and advice!1 -
Hi all, quick update from me:
I have a date this month for mediation over email due to being deaf. Conditions are that I must reply to each email within 5 mins.
From what I've seen I'm to offer £0 or £10 max if I feel some payment is due (I don't as it's not a carpark that takes payment). I'm not to mention anything else about the case other than I'm happy for it to proceed to a hearing. I only have to give 5 mins of my time.
If I've missed anything please do let me know!
I'll update when I have more info.1 -
Yes, that is what you do.3

Hi all, updating in case it's useful for anyone else.
I had my mediation appointment via email due to being deaf.
This is what the mediator passed on to me:1. THE DEFENDANT (D) IS INDEBTED TO THE CLAIMANT (C) FOR A PARKING CHARGE(S) (PC) ISSUED TO VEHICLE ------- AT (862) BROCKLEBANK RETAIL PARK, LONDON, SE7 7SE. 2. THE DATE OF CONTRAVENTION IS 03/02/2024 AND THE D WAS ISSUED WITH PC(S) BY THE CLAIMANT 3. THE DEFENDANT IS PURSUED AS THE DRIVER OF THE VEHICLE FOR BREACH OF THE TERMS ON THE SIGNS (THE CONTRACT). REASON:OVERSTAY 4. IN THE ALTERNATIVE THE DEFENDANT IS PURSUED AS THE KEEPER PURSUANT TO POFA 2012, SCHEDULE 4. AND THE CLAIMANT CLAIMS 1. £170 BEING THE TOTAL OF THE PC(S) AND DAMAGES. 2. INTEREST AT A RATE OF 8% PER ANNUM PURSUANT TO S.69 OF THE COUNTY COURTS ACT 1984 FROM THE DATE HEREOF AT A DAILY RATE OF £.02 UNTIL JUDGMENT OR SOONER PAYMENT. 3. COSTS AND COURT FEES
The Claimant has informed that there is 3 hours free parking here and that you entered at 12:37 and exited at16:01.
There was no appeal.
They have picture evidence.
Your defence is a template.
You admit you are the registered keeper and driver.
The Claimant has offered to settle at £240.00 and would accept this over the course of 4 months.
I did not accept the settlement, I offered £0, I said I was happy for the case to proceed to court and I didn't wish to discuss any more details.
That was all they needed and shortly after I received an email confirming that we didn't reach a settlement.
TBC...
