MOORSIDE LEGAL, NCP court claim

Dont do anything just yet, but do study the 2nd post in the newbies sticky thread in announcements near the top of the forum
Study a few other recent Moorside Legal cases too
You wont be admitting anything, nor will you be filling out any paperwork, just online on MCOL to start with
Please edit your thread title to something more suitable like
MOORSIDE LEGAL, NCP court claim

Thank you. I've updated the post title as per your suggestion and will take a proper read through it tomorrow when I'm a bit more awake 🙂

With an issue date of 10/04/26 and providing you complete(d) the AoS after 15/04/26 and before or on 29/04/26 your defence deadline date is 4.00 p.m. on 13/05/26

So AOS stage online on MCOL later this week if possible, dispute the whole claim as explained in post 2 in the newbies sticky thread in announcements near the top of the forum
Then study a similar case like the current one below

the court address is in Northampton which is 120mi-150mi north of both - if it did go to court is that where I'd be expected to attend?
Of course not. That's an admin centre.
Read the NEWBIES Thread (second post) which explains all this and gives you the template defence.
Then add the points to the usual Template Defence, that the PCN was non-POFA worded - therefore there is no keeper liability possible - and that a company in administration cannot litigate without express permission of the Administrators.
Easy!

What's also perplexing to me is that the car park is based in Worthing, I live 40mi+ to the east of it, and yet the court address is in Northampton which is 120mi-150mi north of both - if it did go to court is that where I'd be expected to attend? And if yes is there anyway to ask for it to be moved closer to me?
Any court hearing will be held at the court nearest to your home address. The Northampton CNBC is simply an administrative centre which distributes the claim forms. They have no involvement in the court hearing. You won’t be travelling there!
As an aside, if I understand correctly, a company in administration can only file MCOL claims via the appointed administrator. The NCP administrator is PWC. Can any regular confirm my understanding of this? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I would also add that the address for NCP is wrong; it's registered office address changed on 28th March 2026 to:-
PRICEWATERHOUSECOOPERS LLP, 8th Floor Central Square 29 Wellington Street, Leeds, West Yorkshire, LS1 4DL.
(Given that the Solicitors are using a PO Box I would suggest that the claim form is now invalid.)

Apologies again for taking so long to come back to you all. Here's what's happened since my last reply:
I saw this comment and put the whole thing off for a while and submitted the AoS on 23/04. I then left it because I couldn't deal with the stress of putting a defence together at the time and ended up forgetting about it for a while.
——————————
I then remembered and in a fluster started putting a defence together on the evening of 12/05 as I had work the following day so wouldn't have been able to do it then, except I had someone continually harrass me despite be sternly explaining I had something urgent to do, which put me under increased stress and didn't get a chance to properly formulate my defence.
So my defence ended up consisting of the template from the newbies thread, the thing that @Umkomaas mentioned about the incorrect filing, some wording I found from another friend regarding what @Castle said, and my personal contribution about the unfairness of the situation and in the nicest possible way how incompetent all the other parties are (which is the part I definitely could have spend more time on if someone had left me alone like I asked them to). Not long after I received a letter acknowledging receipt of my defence (I'm not sure why they haven't included my reference):Since then I hadn't heard anything until I received 2 letters from Moorside on Thursday, both with the same covering letter (or at least if they had tried to call me they hadn't left a message or claimed to have done so in their letter):
As you can see they don't appear to have addressed any of the points I made in my Courts & Tribunals defence.
The first envelope contained a completed HM Courts & Tribunals Service Directions questionnaire, and on the 2nd page they've used the PO box address again:
I'm sure you're all probably used to seeing the rest of the completed questionnaire so I won't upload the remaining pages unless requested.
The second envelope contained copies of all the communication I had with both NCP and POPLA decision (which they've somehow managed to send me 2 copies of 🙄), including evidence I had originally provided.
Now a couple of things I'm unclear on:
- As you can see in the acknowledgement letter it says they have 28 days to contact the court one they received my defence or they'll have to apply to a judge to lift the stay - as my defence was submitted on 12/05 and they didn't write to me until 10/06 (29 days), could they have breached the 28 day threshold? (I'm not sure how or when the above form was filled in), and if so how likely is it that the judge would lift the stay over a parking fine?
- As per their covering letter they've only provided me with the option to pay them (a "reduced" amount), or provide them with more evidence. In other words they haven't provided me with an option for mediation, despite the form they've completed seemingly suggesting they should do so (and as you've all pointed out they would). They also clearly state that their client has completed the quesionnaire, yet they've filled it out themselves - is this even allowed? Or is it likely a judge wouldn't care that they've stupidly referred to themselves as their own client on their own letter?
- As the two points above don't apply to me (no further evidence to provide them and I don't intend to pay), what happens now given that they've not given me further instruction on what to do in this case?
Sorry that I mentally struggle dealing with this causing long delays in replies, it's something I'm trying to get sorted out (but doubt I'll be able to any time soon). But thank you all again so much for all of your help in this, I genuinely appreciate it so much.
