Just send them the NAME AND ADDRESS (abroad) of the actual driver. The person.

Nothing else. No asking for evidence.

This is nothing to do with the keeper once they've transferred liability properly.

    Morning all

After providing them the driver details, we received the following reply

We write further to your recent email.

We are instructed by our client to recover the outstanding balance in relation to the Parking Charge issued to you.

Please note, the timeframe in which to transfer liability has now expired. You were given the opportunity to transfer liability to a named driver when the initial Parking Charge was issued to you. You remain liable for the outstanding balance as the person named by our client as responsible for payment.

You can pay easily by using Scan to Pay, simply scan the QR code located on our letters with your phone and pay by card. You can also pay by card on the secure payment page on the website 24 hours a day www.dcbltd.com/pay-online/.

    Alternatively, use our 24/7 Payment line: 01302 897022— Office number: 01606 539 169 Office opening hours: Monday—Friday 8am—8pm and Saturday 9am-5pm.

    Bank Transfer
    Sort Code: 20-24-09
    Account Number: 60430781

Please quote your DCBL reference number as the payment reference.

Please note, should the balance remain unpaid, it would be the decision of our client on how they choose to proceed.

    Kind regards,

Do we have to reply back stating ECP refused to deal with us stating they have forwarded our details to DCB and also declined the request from Odeon to cancel this ticket? We have kept copies of email as prrof in case this goes further.

You should have written to ECP, Probably on their website or their complaint link, its the claimant parking company that you should be giving the drivers details to,  plus any legal company like DCB Legal

ECP are the claimant,  you write to them,  the organ grinder,  not the dancing monkey

From the above reply,  you appear to have written to the powerless debt collectors,  so they have replied with their clients instructions

Reply to them to tell them to refer the matter back to their client, ECP , and halt recovery actions

More importantly,  write to ECP as soon as possible telling them the pcn reference number,  the VRM details and also the drivers details at the non UK address , which should have been done after the driver went abroad

    Hi Gr1pr
in 2023, we sent an appeal stating the driver paid the ticket and sent them the proof, explained there was not adequate signage, sent them photos to explain why the driver paid at the end of the parking session and not in the beginning, then complained to the Odeon cinema who wrote on our behalf to the ECP but they refused to accept any of these requests.
We couldn't even appeal to POPLA as all this took time and ECP had passed the matter to DCB.
Moreover, we were not aware that the registered keeper could pass on the liability to the driver.

However, we will send these details to ECP today as per your advice  and also request DCB to refer our case back to the parking company but we know what their reply would be!

It doesn't matter what they say as a reply.

The keeper has now transferred liability. End of story.

Why did you believe DCB Ltd? They are lying to you about the legal position re liability.

There's no 28 day limit on transferring liability. Read these:

    Evening all

After providing the keeper details, they initially emailed back stating the keeper liability declaration time line was over. We emailed back stating we respectfully decline their 'claim' and to put us back to their clients.
We also filled in a web enquiry form on ECP websit declaring keeper details and received an automated reply from ECP but nothing else.
Just when we thought, we wouldn't hear anything back, came 2 letters from DCB demanding money.
Shall we chuck them in the bin and wait for the final claim form or shall be reply to them stating we decline any claims and are awaiting a response from ECP?

Here is the link for the document/letter

Do not bin that Letter of Claim from DCB Legal on behalf of ECP

The previous letters were powerless debt collectors letters from DCBL , not DCB Legal

Respond with the LoC response template in the second post in the newbies sticky thread in announcements

    But

Add the details of the driver etc to the opening paragraph,  stating that you have already informed their client of the drivers details,  including their name and address,  ( add the details again,  to be sure  ) and to refer the case back to their client

    Then add

In the alternative,  consider the following   ( then add the LoC response template   )

Also use the ECP complaint routes and complain,  adding a copy of the previous notification of the drivers details

Yep and every time include the driver's full name and postal address even though you're repeating yourself.

     Dear collections team

I have received a letter from your office regarding a notice of intended legal action. Please note I decline your claims as I was only the registered keeper of the vehicle in 2023 and not the driver.

The driver of the vehicle details are as follows

    *****

Your client, Euro Car Parks, was also informed of this on 8th April as per your advice.
I am attaching a copy of the email and their acknowledgement

    Message Body:

    Dear ECP

We have been instructed by DCB Ltd to provide you the driver details for the following parking incident and keep a copy as proof. Please accept the details

    Ref number *****
    vehicle Reg Mark *****
    Date 08/05/2023

    Driver details
    *****
    Address:****
    ****

    ****
    ****

    Thanks

As such the alleged debt is disputed and any court proceedings will be vigorously defended due to the folliowjng reasons:
    1) The driver paid for the parking and there is a proof which will be submitted in the court as defence
    2) The claim letter is directed to the registered keeper not the driver despite passing the keeper liability
    3) the vendor wrote emails to your  client requesting them to cancel the ticket at the time which were ignored
    4) your client have already acknowledged the keeper details, hence your claim letter is baseless

    Yours faithfully
