Small claims court - car issue

9 days they ignored me.
i think it’s unfair ignoring that long when i asked to repair as we only have so long that garages are liable for the faults and i have heard it all before about how much garages deduct off your money buying back a car so id sooner it of been repaired so im out of pocket less.Im going to try and find another car within next few days as they are actually being more fair this time round and offering to buy car back without deductions before they was going to deduct what they saw fit. Which i am much happier about but i still would prefer them to deduct a mileage amount as it’s unfair on them else. As I do want to be fair on them too. Obviously repair would have been the perfect thing for me and I wouldn’t mind of contributed towards bill somewhat but sadly they don’t want to repair car. So I have no choice but to return car or foot the repairs myself isn’t it x0 -
So hang on, they've now offered a FULL refund, and you want them to deduct for wear and tear? This is the same garage you accuse of lying on a review and are in a legal dispute with?dr78 said:9 days they ignored me.

I'm sorry, this is all over the place. It's gone from getting an inspection, serving a letter before action and looking like proceeding to court, to being offered a full refund for a car you've owned for two months. Are you absolutely sure this is the same place you're dealing with? It's coming across as two entirely different stories!
That's me done, I can't keep up with it all. I hope it works out in the end, it sounds like you've got a really good offer.3 -
Today they said they will do a full refund before it was minus this and that. I will go for it but yes I do think they should knock something off for mileage as I am a fair person and not greedy and have been fair to garage all along offering to pay half for some issues. They just ignored me for nine days over it all. Instead of just communicating to find a fair solution for them and me . But yes they was lying on the review and still was ignoring me too. Trading standards have been in touch CA have said so I assume that is why they are no longer ignoring meAylesbury_Duck said:

But yes I sent them letter as was being ignored 9 days so I sent letter which they got Saturday and still didn’t reply to me. Also inspection was also being done today so I am following the steps I should but half hour ago they suddenly emailed offering a fairer resolution finally. In understand it’s confusing, but I was having to do the letter courts etc as they have been ignoring for so long but now they have suddenly got in touch we can resolve it better as one way communication isn’t going to solve issues. I get report from car tomorrow but all I know is so far from garage the car defo should not of passed the mot but will hear more tomorrow on faults . It’s been more of a pain than it needed to be I think. They could have found a solution best for both of us I don’t understand why they don’t want to do the repairs on the car. As surely they will want to sell car on. But suppose won’t be my problem once it’s gone back
apologies for frying your brain but thanks for all the help you have given to me0 -
Right. Finally think it’s sorted, I have since noticed rust under the door rubber which I wouldn’t have thought about lifting door rubbers to look under. So that’s a bit crap but I think sadly that I will have to quote and just pay myself as warranty give up and paid air con issue repair and that is now repaired and car sales garage have also given up and said they will pay clutch replacement so I think quit while I am ahead and pay for the rust issue, gutted I didn’t see the spots though lol1

garage offered yiu a full refund with no deductions , you can’t get a better solution than that
I am confused2 -
He said he didn’t realise car had a clutch judder so he offered to buy car back till he read it had a clutch judder then didn’t want car back and didn’t want to pay for any repairs on the car . He more ignored everything then hoping I’d give in and pay for repairs myself . He was willing to buy car back when it was just the air con issue . He went very quiet and back to ignoring me till warranty become the middle
man and told him he has to resolve it or it will end up in court (but I told him it had a judder) he said he wouldn’t deduct for “the issues” like the air con issue but I feel how can he even deduct money off for something that’s his fault. Also I paid for brake discs and pads all round so I’m invested money wise and it’s not cheap paying out for all that so handing car back I’m 480£ out of pocket just like that hence why I’d sooner repairs on car
