PIP reassessment

Hiya, thanks, due to the surgery and the complications (even the Consultant letter has said my back pain will NOT be fixed with the surgery), I can't walk more than 50 meters without pain, and the medication uplift, driving? no chance. Just bloody feel ashamed, worked all my life and then a stupid company puts me in a position where I'm now physically shattered.Spoonie_Turtle said:
Entitlement to the mobility component is based on physical ability to walk, not driving ability, and on cognitive ability to plan and follow journeys.SpicyParsnip said:… my Job Centre advisor has told me that due to my medical conditions, including a recent major spine surgery, has said you should be awarded PIP at the Higher amount giving me eligibility to Mobility component due to being told not being able to drive for some time and the surgery having found damage to spinal cord in lower back causing considerable pain when driving for any more than a short period and sadly damage to bowel control.
Hope that makes sense!
(It could be good to start your own thread to get further advice - unfortunately many Jobcentre employees are either ignorant or misinformed about benefits so do not take their advice without first checking they're correct.)
That sounds good but I'm afraid I will only fully believe it when they've actually taken it out. Intentions and plans seem to count for less and less in politics these days.HillStreetBlues said:
They will be removing clause 5 (below) at the committee stage.Spoonie_Turtle said:Not to get too political or to debate the rights and wrongs, but it was my understanding they haven't actually removed the 4-pointer change, just said it won't come into force until after the Timms review. So they've still left themselves open to being able to bring it in. It's a stay of execution rather than a pardon, to use a clunky metaphor.
I would be very happy if I've misunderstood and it truly has been completely removed, of course.5 Personal independence payment eligibility

Regulations 2013 (scoring for daily living activities) for paragraph (3)
substitute—
“(3) C has limited ability to carry out daily living activities where, having
undergone an assessment—
(a) C obtains a score of at least 8 points, but less than 12 points, in
relation to daily living activities, and
(b) at least 4 of those points were awarded for a single daily living 30
activity.
(4) C has severely limited ability to carry out daily living activities where,
having undergone an assessment—
(a)

C obtains a score of at least 12 points in relation to daily living
activities, and
(b) at least 4 of those points were awarded for a single daily living
activity.

40
C was entitled to the daily living component at the standard rate or
the enhanced rate immediately before section 5(1) of the Universal
Credit and Personal Independence Payment Act 2025 (which inserted
this paragraph) came into force,
Law wise it's not delayed it's totally removed.
Every charity opposed the 4 pointer, and more than 120 Labour MPs also opposed it, they only got the Bill though 2nd reading by removing clause 5
The 4 pointer is now a dead duck, whatever you think of the Government they are not that stupid to reintroduce it again.0 -
No need to feel ashamed! Disability is not a failing. (I know it's not as simple as saying it, and disability comes with all sorts of complex emotions including grief, but it's important to know that it is not a personal or moral failing in any way, even if it's difficult to believe that at first.)SpicyParsnip said:

For walking ability, being unable to walk 50m scores 8, to get the standard mobility element. To score 12 for the enhanced rate you have to be unable to walk 20m (unable to do it repeatedly/reliably/safely/in a timely manner/etc.)
If the medication severely affects you cognitively then it's possible you might score on the planning and following journeys, but it is a high threshold to score on that activity.
