Tesco Harrow - Horizon Parking Charge

Hello There,

Can someone please confirm if the issued ticket is POFA compliant? I have sent an email to the Tesco CEO but haven't heard back anything yet. I haven't yet made an appeal, wanted to know if I should ignore if my appeal is rejected? Already checked with Tesco manager and he was helpless.

    Can I still use the below template for the appeal?

    This is an appeal by the Registered Keeper - No driver details will be given. 
    Please do NOT try the usual trick of asking for driver details in order to get around the fact that your Notice to Keeper does not comply with Schedule 4 of The Protection of Freedoms Act 2012.
    As there is no keeper liability, liability cannot flow from the driver to the keeper and so this will be an automatic win at POPLA. Please cancel this Parking Charge Notice or issue a POPLA code at which point you will auto withdraw.

    Also, to add more information, I went to Tesco for grocery and have receipt for the same. Can that be used anywhere?

    Yes, for 'Plan A' whereby you ask Tesco to cancel the PCN as you were a genuine shopper and needed more time then whatever paltry limit (2 hours? ) is 'allowed'.

    Was there a reason you were there that long? Children? Disabled driver/passenger? Massive weekly shop?

    Thanks for the response. I usually go to my nearby ASDA store for the shopping but as I recently bought a car, so thought to fully explore the Tesco store hence it took time. I was there with my wife and 3 year old. As informed by my neighbour, my understanding was this store offers 3 hours of free parking hence this issue happened. I also sent an email to Tesco's CEO and got the below response from Customer service on behalf of CEO:

    Hello

    I’m very sorry that you received an unexpected Parking Charge Notice after shopping at our Station Road store recently. I understand you were exploring what we have to offer and appreciate this must have been a shock to you. 

    Parking times are enforced in our stores to make sure there’s always an appropriate space when our customers need one. However, it’s also important to us that everyone shopping with us is treated fairly and we work with a small number of parking companies to make sure they give the standard of service we’d expect. This includes regular checks that there’s appropriate signage so that everyone knows exactly how long they can stay. 

    To make sure we’re consistent, we ask that any appeals are made directly to the company issuing the charge – in this case Horizon. This is why my colleagues in store won’t have been able to help you. From what you’ve explained I can’t promise that your charge would be cancelled, but you will be able to find the details to appeal on the letter that you received. 

    I hope that despite this charge you will still consider shopping with us. 

    I have responded showing my disappointment with Tesco stance on this matter and now waiting for their response again.

    I wanted your advice on what basis should I appeal in this case? Should I explain to them the exact situation? I am thinking to appeal by the EOF today as I want to appeal within 14 days period. What is your advice here?

    I went to Tesco yesterday again and checked with the Manager again but he asked me to reach out Horizon only as they can't do anything.

    OK so try the appeal you planned, even though it's POFA worded. Looks like their appeals team haven't been brought up to speed and are still cancelling them when people use that appeal:

    Attach your receipt as well and say that 'WE' (not 'I') usually go to ASDA for shopping but we thought to fully explore the large Tesco store, hence WE were unfamiliar with it and it took time, especially with a toddler. We have complained to Tesco in store and to their CEO and are awaiting a reply. Receipt attached. Surely you aren't there to lose repeat customers for Tesco?

    Of course not. You NEVER choose one that says "I".

    And obviously don't capitalise 'WE'!

    My bad, which one should be good to go with -  'Other' or 'I was not the Driver'? 

    Noted for 'WE'

    As I visited the same store 2-3 times after this incident happened, should I share the receipts for the same day or for other days as well just to prove we are the genuine customers?
