Group Nexus/CP Plus Ltd - 2 Parking fines from same retail park - One DCBL notice letter received

Hi,
I have just received a DCBL letter asking to pay £170 for a PCN from a 'vehicle remained on private property in breach of the prominently displayed terms' on November 2024. This is from the first PCN fine, in which i had appealed at first, stating the signs were not clear and not aware of them and that also they had not sent me a reduced amount letter but only sent a increased fine in which the appeal was rejected and no notice of the reduced amount was given. I have ignored all further letters since leading to the DCBL letter. This letter also arrived weeks after the even happened in January 2025.
The second fine came from the same retail park at Mountbatten Retail Park in Southampton on the same basis, I had went into the car park and then came back out again, 'double dipping', and it says i had overstayed the time and parked, when the image on this particular fine seemed to be very dark and blurry and shows no sign of bay parking. I have not responded or appealed to any of the increased cost letters and is now reached the letter before passed on to DCBL for debt collection. This one occurred in January 2025.
I am thinking of contacting the landowner having found the company who owns the retail park to get the fines squashed. It has been 6 days since i have received the Debt letter, which I believe is just a scare tactic. Any help would be appreciated in moving forward.

Definitely not Fines, they are invoices for the alleged breaches of the parking contract on that private property
( Magistrates issue fines, this has nothing to do with Magistrates or Fines )
Did the pcns comply with Pofa 2012 ? Or not ?
As keeper but not the driver you have another choice to make ( apart from the landowner complaints )
Are you willing to fight the Private Parking Company in civil court in the future, as the non driving keeper ?
Or
Are you willing to provide the driver's details to the parking company, before they issue a court claim using MCOL ?1 -

Southampton court hate PPCs. You'll be all right if these go to court.
Re the double dip one, email their DPO and head it up 'formal complaint' using the words you find on other threads when you search the forum for:
complain orphan images double dip
Your account is confusing though. Are both PCNs from January 2025?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Your account is confusing though. Are both PCNs from January 2025?I have drafted a single letter to send to the landowner to squash both fines or is it better to do 2 separate? No so one PCN is from November and the second is January. The car park only recently put this whole able system in recently as never had a problem before.0 -
One letter is OK as long as you keep it concise.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Coupon-mad said:One letter is OK as long as you keep it concise.Formal ComplaintDear Sirs,I am writing this email as I understand yourselves, Curson Sowerby Partners are the owners of Mountbatten Retail Park in Southampton. I entered the car park back in November 2024 and January 2025 and was unable to find a space when doing a pickup so exited the car park. I then re-entered the car park shortly afterwards and had gone into a bay shortly before leaving again within the time period. On the second occasion there was no parking involved when doing a pickup, having to leave the car park to return once again in that time period.Weeks later, falling outside the 14-day period, I received Parking Charge Notices (PCN) from Group Nexus who I understand are the company controlling your car park. The PCN was issued was for £100 and the letter explained that it was now at this high figure as I failed to pay the original offer. After researching this car park online, it appears that this is a common problem and it would appear Group Nexus are trying their hand at regularly issuing issue the higher figure first which they are not supposed to do. They have now done this on both the PCNs I have received from them.I immediately contacted Group Nexus that I didn’t receive the initial PCN and even though I am the keeper I was not the driver. I received an email back saying they are rejecting my appeal on the basis that signage was clear when that was never the issue but also have not provided evidence of me entering and leaving the car park on 2 occasions which I have since discovered is also a common problem with private parking companies and are upholding the PCN so will be rejecting my appeal. At no point did they explain the question regarding the first missing PCN and proceeded to send me more threatening letters increasing the costs. They may now be in breach of General Data Protection Regulations (GDPR) and obtained my personal data without a valid reason for a parking event.I am now receiving what I can only call threatening letters from DCBL explaining that if I do not pay the now increased amount of £170, I could be taken to court. This not a fair act in my opinion and after doing hours of research I can now see that ANPR cameras are actually able to miss entrances and exiting of cars “double dipping” and in this circumstance is clearly the case. The use of ANPR cameras has been banned by the UK Government in council and local authority car parks because it has been deemed to be unfit for purpose. I believe unregulated private parking companies such as Group Nexus use these cameras because the errors caused by them generate income.I am extremely upset with how Group Nexus has handled this whole situation and with all this in mind and the fact I did not actually park in this car park on one occasion and I have shopped at this retail park before, I am finding this whole process extremely stressful.I have been advised to send you this email and am hoping that this is something you will be able to assist me in squashing these fines. I look forward to your response.Yous faithfullyPCNs: XXXXXXXX0

Same as the one in the NEWBIES thread post 4 pictures, then. No need to show us the DCB Ltd threatogram as it matches the one I show you already in the resource thread.
But they are 2 different PCNs on different days. Would have been easy to appeal the January one as it's non-POFA (dates and wording).
DCB are chasing one.
Were these both double dips?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
