UK Parking Control Limited / DCB Legal Limited - Defended Claim

Hi, I have tried searching the forum but to no avail.

Keeping it simple, I emailed a defence three days late and have just received a Judgment for Claimant (in default) letter.  Annoyingly, I missed timed how long I had to send the defence.  

My question, is my only option now to pay the UK Parking Control Limited (via DCB Legal Ltd) £286.88 (£176.88 debt + £110 cost)?

Appreciate any advice you can provide.

    You could try a set-aside but that will cost you £303 and as you missed the deadline, you might have a job persuading a judge to set it aside, as they don't like credit cleansing which is what it would be.

    Further information received shows that you (OP) sent your defence BEFORE the deadline and received confirmation, meaning my comments are null and void and  Isee you have been given advice (which you have acted upon) to complain to CNBC.

    You do have the option of not paying and just living with a CCJ for 6 years.

    They only attempt to enforce £600+ judgments.

    Presumably it depends why the defence was filled late though. Disability or poor health, for example.

    No.  Defence email was sent and an acknowledgment received on Sat 1st March 2025.  Date on the judgement letter is Tues 4th Mar 2025. 

    Is there anything I can do?

    Yes that CCJ MUST be reversed by the CNBC if the Judgment date is after the date you emailed the defence.

    Send a complaint email immediately to the CNBC attaching the proof of emailing the defence and getting the acknowledgement BEFORE judgment was entered.

    DO NOT ACCEPT BEING TOLD YOU HAVE TO FILL IN AN APPLICATION/PAY A FEE.

    You don't. This has to be set aside next week.

    In my complaint email, should I ask for the CCJ to be set aside or reversed?

    Hi, copied below is the complaint email I have drafted to send to ClaimResponses.CNBC@justice.gov.uk.

    Would you mind giving it a check and letting me know if I should make any changes, please?

    **Subject:** Urgent Complaint – Improper Default Judgment Issued (Claim No. [INSERT CLAIM NUMBER])  

    Dear Sir/Madam,  

    I am writing to formally complain about the improper entry of a Default Judgment against me in the above-referenced claim, despite having submitted my Defence in accordance with the prescribed deadlines.  

    On 1 March 2025, I emailed my Defence to the County Court Business Centre (CNBC) and received an acknowledgment of receipt on the same date (attached for reference). However, on 4 March 2025, I was shocked to receive a "Judgment for Claimant (in default)" letter, indicating that judgment had been wrongly entered against me. Given that my Defence was submitted and acknowledged before the judgment was entered, this constitutes a serious procedural error.  

    It is wholly unacceptable that judgment has been entered in default when the court was in possession of my validly filed Defence. I demand that this improper judgment be set aside immediately and without cost to me, as it was clearly entered in error. Furthermore, I request confirmation that this matter has been rectified without requiring me to make an unnecessary and costly formal application.  

    Please confirm urgent action is being taken to correct this serious mistake, ensuring that the improper judgment is set aside without delay.
