Am I liable to pay if I didnt change my V5?

Apologies if this has already been discussed but I couldn't find it anywhere!?

I need advice please as I received a LBC from CST LAW last year working on behalf of Smart Parking.
The original fine was from Asda in March 2023 but the first letter I received about it was the LBC in January 2024 asking for £160! I tried to appeal to Smart parking and CST law straight away saying that I hadn't received any evidence or previous letters. Smart parking just denied my appeal saying that it was outside the 28 days and CST law never respondend to my email when I asked for the evidence.
I realised that I had moved in 2023 and even though I changed my drivers license, I didn't realise I had to change my V5 aswell ( this has now been updated)
So my question is, is there any point in trying to fight this or will they just say its my fault for not having the correct address on the V5?
As CST law didnt ever get back to me I forgot about it, but am now getting threatning letters for DCBL saying they are taking legal action against me!?
Thank you for your help!

    Hello and welcome.

You now need to write to Smart, DCBL and CST Law giving them you new address and instructing all of them to erase you previous address from their records. Failure to do that will likely see DCBL and/or CST Law assume that the address they have just written to is no good, and revert to raising a Claim at your old address - which in turn will go unanswered so a Default Judgment is filed against you. What a mess to unravel that would be.

Then follow the guidance in the opening paragraphs of the the second post in the NEWBIES thread.

Thanks, I've adjusted my earlier post.
I still think it's a good idea to get CST Law to correct their records - I wouldn't put it past them to crawl back out and raise a Claim at the old address.

    To the OP

Your thread title asks a question

The answer is possibly yes, but only if a judge says so,  in court,  otherwise it's No

Thank you. Should I not engage with DCBL directly then, just Smart parking?

    DCB Limited or DCB Legal?

Thank you for your help! Should I also try to contact Asda to get it removed, or is it too late now that DCBL have it?

Asda are usually very good at getting PCNs cancelled, but their preferred parking management supplier is ParkingEye.  Is this Asda store based on its own site, or on a retail park?

Interestingly, the site has now changed to parkingEye! I went back to check recently as I thought it was 3 hrs that I was allowed ( I was 2hrs 15 mins) and saw the parking eye sign which is now for 3 hrs! Not sure if this also helps my case? Its on its own site.
