    I am so near to finally completing the C1 form. Thanks to the posts on here and Buddy9 I am so grateful for everyone's input. 
    I have one final niggle which I think will cause problems, if not now, then in the future. My mother holds a small amount of shares and with one company her shareholder name is not the same as in her Will. Should I add her 'extra' name in the C1 form? Thanks in advance.

    If it is only an investment that has a different name then you could do as suggested in the C3 guidance - on page 2 para 1 box enter both names 

    Such as Jean Kettle otherwise known as Jean Keatley 

    or

    Agnes Mary McDougall or Murray

    There is also a utility bill that has my mother's first name different, not that she was ever known by that name but it seems the 'aquired' name could be because they thought her first name was a shortened version of her first name. Her birth certificate shows the shorter name! 

    Yes, I shall add in that name to the page and paragraph suggested thanks.

    Also I am using C2 additional inventory page but after filling it out online I see it has 12/12 at the bottom!! Have I overlooked an updated version or will this be okay? Forgive me for these endless questions. I can see why people use lawyers during this stressful time! Thanks in advance and for all your previous help Buddy9. Much appreciated.🙂

    Hi everyone. I'd just like to say thank you Buddy 9 for all your help. So very grateful to you for all your helpful replies. Couldn't have done this without your dedicated support. You are worth your weight in gold! My Confirmation was passed today. Just waiting for certificates in the post now!
    This is a first class site.
    One minute issue, which thankfully didn't result in my application going back into the system (was rectified online), was that I mentioned the lawyers on page one of the C1 form as nominate Executors in my mother's will. Since I was dealing with the C1 form myself the lawyers stepped down, giving a letter of declination. It is a little misleading in the form where it asks to list all the Nominate Executors in order from the will! All I had to do was eliminate their details from page 1!! The Sheriff Court in Edinburgh were really helpful too. Just glad that this is finally over but good to know that there are friendly and helpful people out there. To anyone considering completing a C1 form by themselves, with the help of this forum, Go For It! And save yourself some money! Thanks again Buddy 9. You are brilliant!

    I have finally got an original copy of my brothers Will from the solicitor and I wish to proceed myself if I can. 

    However the solicitors in drafting the original Will incorporated themselves as (trustees Limited) as executors.  I stated that I wanted to try and do this myself and they said I would need to get a minute of declination for them.

    I have looked online and come up with something that I need to check if it is acceptable before I drop it off to their offices to sign.

    Would this be acceptable.

    MINUTE OF DECLINATURE

     

    We, Messrs Name (Trustees Ltd), having our registered office at Street, Town, Postcode, being nominated as executors in the Will of the late  full name, who resided at Street, Town, postcode, and who died on date hereby formally DECLINE to accept office as executors of the said estate.

    We understand that by signing this Minute of Declinature, we renounce all rights, responsibilities, and authority associated with the role of executor, and we consent to the remaining executor(s) proceeding with the administration of the estate.

    I presume that you are a joint executor. The declinature does not need to be witnessed and might only need one signature.

    Has the solicitor asked you to draft a declinature? One would normally anticipate that the solicitor would draft the declinature, and charge for it. My own thoughts on content are below. Others may prefer a different style.


    I, (name), on behalf of (Name of Trustee Co) having its registered office at (Street, Town, Postcode), do hereby decline the Office of Executor to which (Name of Trustee Co) was appointed by the Will of (name of deceased) who resided at (address) and who died on (date), dated said will (date of will).
