C1 Confirmation please help a newbie

I have been trying to complete C1 confirmation on behalf of my late Mum, I have been assigned as the Executor after my Step Dad resigned as he is blind, grieving and elderly. I have already had one refusal from the courts and am desperate to get it correct before I resubmit. The first was sent by post but I am considering a 4 hour round trip to submit to Elgin Sheriff Court in person tomorrow.

This forum has been an absolute godsend in assisting me but I am now at the stage I think I have it correct but I would like reassurance, If I attach the paperwork on here can somebody take a quick look and see if I have made any mistakes.

  1. The first page I have put Mum's address as the Care Home she was in for the last 7 months, is that correct?
  2. Have I got the figures in the correct boxes?
  3. Have I got the correct 'wording'
  4. Have I docquetted the Will and the Deed of Assumption and Resignation, do I need to make reference to the fact Dad has resigned on the C1 form?

    The para 2 declaration needs some changes and the house description could be improved.

    But a couple of questions first:


    Why two names for mum? Is the will name a previous name?

    Are you certain that the house title is in joint names and there is no special destination  (survivorship clause)?

    You show the estate value around £140k. For the purposes of question 25, who inherits?

    Mum was christened Florence Doreen but dropped the Florence so was only known as Doreen, it is recorded as such on her Death certificate and her will refers to the full name of Florence Doreen but her bank account is Doreen.
    Definitely no survivorship clause it was purchased as each had a 50% share, title states, equally between them and a Solicitor has verified that.
    Her husband my Step Dad inherits everything.

    A care home address would be appropriate.

    Docquetting looks ok.


    Suggestion for para 2.

    That I am

    by her will dated 28th March 1990 and registered in the Books of Council and Session on 20th January 2025 the said deceased appointed [stepdad’s name and address] to be her executor-nominate. By deed of assumption and resignation dated [date] and registered in the Books of Council and Session on 20th January 2025, the said [stepdad’s name]  assumed me as executor of the said deceased and resigned the post of executor. Extracts of the said will and the said deed of assumption and resignation are produced herewith, docquetted and signed by me as relative hereto. I am the daughter and executor-nominate of the said deceased. In said will the said deceased is designed as residing at [address] a previous address.



    Suggestion for house entry:

    Omit the first eight (plus) words.

    Typo ‘registestry’

    After title number use the following text instead:

    Valued by executor

    Value of [insert address] £260,000

    Deceased’s one half pro indiviso share


    For Q13 and Q14. I would enter zeros rather than leave blank.

    For Q25. If all goes to the spouse then IHT spouse exemption applies and NQV is zero. (this assumes that all children have renounced legitim).

    I am having a nightmare, as I cannot fit your suggested text into the box paragraph 2. I have tried every which way I can think of to do it. I am now typing the whole form out again as I cannot get it to accept any new text on the old form or the saved forms I had previously.

    If you cannot accommodate all the text in the box of para 2 then print para 2 on a separate sheet and in the box enter ‘see a paper apart’

    Hi all. I am trying to help a friend get confirmation for her Dad’s estate. The local court has advised that paragraph 2 needs amendment and we are now thinking this will suffice but would appreciate guidance and suggestions. Thanks v much in anticipation: 

    2. That I am 
    ‘Minnie Mouse’ along with ‘Daisy Duck’ residing at ‘6 Disney Street, Mickeytown’, the Executor Nominate of the said deceased conform to his will dated 20th October 2014 which is produced herewith, docquetted and signed be me as relative hereto and that myself and the said ‘Daisy Duck’ are daughter and widow of the said deceased. 


    We have tried to follow the advice in previous posts but would really appreciate some reassurance or suggested amendments as needed. Thanks

    Omit the name ‘Minnie Mouse’ 

    Amend part to read … and the said Daisy Duck are, respectively, daughter and wife of the said deceased.
