SCS Cancellation policy

Hi, I’m wondering if I could get some advice on scs furniture about a cancellation that I requested regarding furniture. This happened in November 2024, I was told by them that I have no right regarding this. I’ve been in touch with the ombudsman over this and believe me they’ve tried to resolve this and told me this morning in an email that they can take this no further as scs have stated that they stand by their terms of cancellation. There’s a lot more to it than what I’ve said and it’s very long winded to say the least. I’d be happy to discuss this in detail if someone else has had the same issues with them . Any advice would be appreciated with this

Why did you wish to cancel?

If it’s an in-store purchase and you’ve just changed your mind, then there is no legal right to cancel. You would only have this right if their policy allowed it.1

Worth noting if there is a problem, such as delayed delivery, there is a right to treat the contract at an end depending upon timerames:

Hi , thanks for your response. Me and my partner back then had just been talking about getting a new setee so while we were out we nipped into scs just to get some ideas of what we wanted at the time. As we entered the store a lady asked do we need help to this i replied no we are just looking , then we just sat on a suite and we were talking about it with each other and she just started with her sales patter then one thing led to another and that was it she never left our side where ever we went then before we knew it she had us trapped. I’ve got to add that I never intended to buy anything let alone walk away with nearly £2000 of debt. I wasn’t sure that I could get credit and that’s why I wanted to go and look at a few stores, I did tell her this, so the day after when I’ve looked over the contract she has ticked a box stating that she has told me about the cancellation policies and I’ve agreed to this. The lady never mentioned anything of the sort and I didn’t tick the box to say she had now I’ve never been in debt ever so all this was new to me . I’ve been involved with the ombudsman regarding this wich has took 3 months and I’ve also stated and proved that I’m homeless now and we are no longer together and still the ombudsman has tried to resolve this and can’t also apologised that she can’t do anything more0

I'm afraid that unless you have evidence that the sale contract was somehow falsified, you (and your ex-partner?) have no right to cancel without consequence.1

Sadly only thing you could do would be to sell the sofa to help offset the finance payments.Life in the slow lane0 -

That aside, they can't force you to buy a sofa (I'm assuming you haven't taken delivery?) however they can retain either costs or loss of profits. Did you pay a deposit, if so how much?In the game of chess you can never let your adversary see your pieces1 -

It has not yet been delivered and I know that they would have trouble in trying to deliver it as my x partner wouldn’t take it , yes my x partner paid a deposit of £115.00 as I had no money in my account plus the contract is in my name not my x partners0

CCTV isn't going to demonstrate you were strong-armed into signing a contract or that someone falsified information on it.
Is there a risk that your ex partner accepts the delivery, knowing that it's you that's paying for the sofa?
As advised above, you may cancel the contract but SCS are entitled to something. If you're lucky, it's the deposit only. If it's more, come back and tell us what they're asking for and we can advise whether it's reasonable.1
