  • Hi, I’ve not got any evidence to support this only her word over mine. I have mentioned that this would be on cctv in store but even that would be a stretch. It has not yet been delivered and I know that they would have trouble in trying to deliver it as my x partner wouldn’t take it , yes my x partner paid a deposit of £115.00 as I had no money in my account plus the contract is in my name not my x partners 
    Good you haven’t had delivery.

    Store purchase terms don’t seem to mention cancelling but do mention retaining 25% if they can’t deliver after two attempts.

    If you offered them £500 (minus deposit) to walk away they might accept.

    As they only have a small deposit you might have some wiggle room there as forcing costs/lost profit via the courts would be relatively expensive for SCS.

    You need to notify them you are breaching the contract by refusing to fulfil your obligations under it.

    You mention credit, have you cancelled the credit? Are you able to?

  • I’m certain that my x partner would not take delivery at all as she wouldn’t do that out of respect. I’m going to wait for them to contact me as they know my situation and see how they respond, in regards to the deposit paid , they are welcome to it!!! I’ll let the forum know of any update I get . Thanks again

    Hi , unfortunately I’ve not cancelled the credit and to be fair I wouldn’t know how to really as I’ve never done anything like this before so it’s all new to me , if you could advise on how to do this I would be grateful. As of now they haven’t contacted me yet with any further delivery date or anything else for that matter

    Send a time is of the essence letter. You can get a template from CAB.

    Not sure if you'll be able to cancel the credit if it was taken out in November 2024. What does the paperwork say?

    Did you do the "customer confirmation by 6th December" as per the last two bullet points?

    6. Delivery Lead Times


    6.1 We will tell you of the delivery lead time (in weeks). All lead times are approximate only and delivery may vary by up to 4 weeks (earlier or later) than the lead time given. The delivery lead time is on the order. We will only take your order if you agree to the delivery lead time and its approximate nature.


    6.2 If we do not deliver your products within the estimated lead time plus 4 weeks (the “delivery period”) then you may cancel your order in the following circumstances:

    • We have refused to deliver the products;
    • Delivery within the delivery period was essential (taking into account all the relevant circumstances); or
    • You told us before we accepted your order that delivery within the delivery deadline was essential.


    6.3 If we have not delivered your products within the delivery period but none of those circumstances apply, you may call us to specify an appropriate further delivery period. You may cancel your order if we do not deliver within that period.


    6.4 If you cancel your order for late delivery, you can do so for just some of the products or all of them, unless splitting them up would materially impair their value or character. If the products have been delivered to you, you will have to return them to us or allow us to collect them, and we will pay the costs of this.

    Hi, I’ve not done any confirmation at all. All I’ve received from them is a delivery date on the 17/12/2024 for the 21/12/2024 and that’s it but as I told them we’re just waiting for the ombudsman to view the cancellation dispute with yourselves so we can’t take any deliveries from you and that’s all I’ve heard.

    Hi, after checking my messages I’ve also had a delivery update on the 07/01/2025 for the 13/01/2025 again I told them the same thing as my case with the ombudsman was only viewed on the 25/01/2025 as I didn’t have a letter of deadlock from them which I asked the store manager for twice and got no response
