    Why not just use the alternative defence (with Chan & Akande) that the Template Defence tells you to use for any such claim by DCB Legal for Group Nexus or ParkingEye?

    I can tell it's one or the other. Which?

    The Claimant is CP Plus Ltd T/A Group Nexus

    The Address for sending documents/payments (Solicitor I assume) is DCB Legal.

    I will check this again, not great when there is that much information in one post but I am breaking it down and putting my defence together. Could I ask what or who is MSE@C-m? Is that someone who's put a template defence for this?

    With a Claim Issue Date of 14th February, and having filed an Acknowledgment of Service('AOS') in a timely manner, you have until 4pm on Wednesday 19th March 2025 to file a Defence.

    That's over two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.

    Particularly this bit...
    3, The defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason Vehicle remained on private property in breach of the prominently displayed terms and conditions.
    So it is alleged that the driver 'breached the terms on the signs (the contract)'.
    And that allegation is then repeated - 'Reason: Vehicle Remained On Private Property In Breach Of The Prominently Displayed Terms And Conditions'.

    Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.
    This will be an easy win.
    Thanks for this. Reassuring to hear - I have already had to pay once for not filing a defence on time to avoid a CCJ so I am determined not to let that happen again.

    I travel around the country and constantly caught out by these people with their tricky parking sign schemes. Have received numerous fines after paying for tickets and so on so it's clearly a scam in a lot of instances.

    I did use this template as suggested and in the template at paragraph 6. it says "6. (Add basic facts and/or admit or deny the paragraphs in the woeful POC one by one)"

    So this is where I have put in that wording that I posted earlier about me working at the starbucks and not seeing the signs.

    Is this correct? I'm pretty much ready to email the defence now to the claim responses address (subject line I've put "DEFENCE Claim ******")

    Yes, good! But I wouldn't say you were working.  Two reasons not to:

    1.  an employee might be considered more likely to know (or should know) the terms;

    2.  an employee (at work) can't rely on the Consumer Rights Act.

    Edited to say I was just at starbucks not working - I'm about to send that off, I signed and dated the email, assuming there's no need for a written signature?

    I'm a bit confused about what to do next, am I done now and just wait to hear? It says the following but not sure about if there's anything left for me to do? Am i waiting for the directions questionnaire now, when do I submit a witness statement and evidence?

    *****IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!

    The first 12 steps are set out in the Template Defence thread including the fact you can email your defence and your Directions Questionnaire so please don't ask about the early stage forms!

    There will be:
    (a) Directions Questionnaire (N180) stage - an easy form - EMAIL IT as per the Template Defence thread first 12 steps. Please read them again now.

    (b) Witness Statement & evidence stage.

    (c) if they don't discontinue (VERY COMMON THAT THEY WILL - DCB LEGAL ALWAYS!), there will be a hearing at your local court. Nothing scary.

    Weeks or months after you defend:

    The CNBC will send you a DQ N180 form, that must be completed & returned to the CNBC (or if you've put in a counterclaim it goes to the local court).

    Always cc in the claimant's solicitor from this point onwards.****
