chrisbur said:As far as the minimum legal holiday entitlement is concerned the requirement to accrue your holiday before you take it can only be applied to your first year of employment.

"
Accrual systemFor regular hours workers, annual leave begins to build up (‘accrue’) as soon as they start their job. An employer can use an accrual system to work out a worker’s leave during the first year of the job. Under this system, a worker gets one-twelfth of their leave in each month."
However I do agree with Savvy_Sue a grievance may not be in your best interest.

Assuming that you only get the minimum entitlement to holiday of 5.6 weeks ( including bank holidays) then after two months I would expect you to have accrued 2/12 of that or just under one week. As you work 4.5 hours a week for 5 days you have a 22.5 hour week so holiday accrued so far is 21 hours.

Have you been able to look back at your payslips for last year, to see if the figure increased each month, and what it shows when you took leave? In particular, I'd be interested to know what your December and January payslips said?

Have you been able to look back at your payslips for last year, to see if the figure increased each month, and what it shows when you took leave? In particular, I'd be interested to know what your December and January payslips said? Please note that this doesn’t necessarily mean you will be paid for the entire leave period, as it willdepend on how much holiday you have accrued until your departure date.Calculating the remaining number of paid holiday days is up to you.Your payslip displays the holiday amount accrued each month and the total holiday accrued until thatpay period. You should then multiply the hours worked per week by your hourly rate and divide thetotal amount by the total holiday amount you have accrued until that pay period. Here’s an example (this is NOT based on your real figures):Hours worked per week (assuming a Mon-Fri role of 4 hours per day): 20Hourly rate: £13Holiday accrued per month (excluding bank holidays): £86.67Holiday accrued until this pay period: £260.00How much do you earn per day: 4 hours x £13 = £52.00How many days of holiday do I currently have: £260 / £52 = 5Please note that when booking the holiday in advance, it is also essential to consider future holidayaccumulation between the current pay period and the date you will commence your holiday.Using the example above, if we book a holiday one month in advance, we should assume that sincewe accrue £86.67 on a whole month of work, your holiday pot at the date of commencing yourholiday will be £346.67 (£260+£86.67=£346.67).Please let me know if you have done these calculations and still have questions.
This is an email I received as an example of how to work it out0
