DCBL - National Parking Control - Possible Court Action

Back in July I mistakenly parked outside of a parking bay.  No ticket was left on my car, so I thought no more about it.

In November I received a "final notice" stating that the fine had now increased to £170 (with no option to pay a reduced amount.  A bit strange on the basis that no other warning had arrived in the post, and a bit unfair I thought.

Following a bit of info on here, I ignored it but this has now proceeded to a letter this morning from the HM Courts and Tribunals Service, threatening a CCJ if payment is not made.

Any thoughts on how best to progress this?  Obviously I don't want a CCJ, but I'd rather not part with the (now) £170 plus legal costs that I'm now being asked for.

    Nothing strange about it,  all standard stuff so far

    Presumably you have an N1SDT claim pack from the CNBC in Northampton using MCOL   ?

    Post the issue date on the claim form,  plus the name of the parking company and lawyers in the top left of the claim form , no personal details are allowed on mse,  so dont post personal or private information 

    Post a redacted picture of the POC on the lower left of the claim form after hiding the VRM details first 

    Seems to me that this has passed the debt collectors stage and also passed the Letter of Claim stage too

    Took me ages to find the form name, but yes it's a N1SDT, and yes to CNBC and MCOL!

    Issue date is 18th Feb 2025.

    Claimant is national Parking Control Group Ltd, Crawley.

    I'm assuming the lawyers are DCB Legal Ltd, Runcorn.

    Was the pcn ISSUED on that POC date   ? Or is that POC date the incident date with the postal pcn issued later   ?

    The date of contravention is 19/7/24 on the Final Notice (the first one I received).  Final notice is dated 14th November.  I can only assume that the PCN was issued on or around the date of contravention.

    Hope that makes sense.  doesn't help not having any documents prior to November, nor a PCN on the car!

    No windscreen pcn was issued on the incident date 

    So the POC date is incorrect,  it wasn't issued on the incident date,  but maybe several days later

    No windscreen note at all.  first I heard was the letter in November.

    I park there regularly, so the contravention could have been any day, all I have is there letter saying it was on that day (19/7/24).

    With a Claim Issue Date of 18th February, you have until Monday 10th March 2025 to file an Acknowledgment of Service('AOS'), but there is nothing to be gained by delaying it. 
    To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an AOS in a timely manner, you have until 4pm on Monday 24th March 2025 to file a Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.
    Don't miss the deadline for filing an AOS, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

    Bear in mind that not putting a ticket on the windscreen and not a sending you anything through the post is an easy way to jump straight to £170, and even more for a court claim + a fee for DCB rather than just be handed £60 at the time.

    This an increasingly common tactic thanks to DCB Legal's bulk litigation offerings and the ease at which they can use the court system as a debt collection service.

    Needs looking at.

    They may not have sent the notices but make sure they didn’t go to old address. Check address on your V5C especially with you parking there regularly.
