GingerTim said:True, but the CEO is a muppet who appears not to understand his company is liable for these payments...Oh I think he does, Be interesting to see how he "plays" this.Update : no switch, no contact from Tomato as yet so rang customer services today. They still have a problem with over 1000 on the failed switch list. I'm now on "The spreadsheet" of all those waiting to be switched over that had failed in the past. Interesting the young lady who took my call tried to push through another go at a swap date which "her words" was blocked again. I'm assuming slots have to be booked in advance as she mentioned next week as that next available date. The wait continues...0

There are some conditions in the relevant act which exempt the supplier from having to make the £40 payment.
Possibly section 3e in this link may apply if TE can demonstrate the delay was outside of their control.
That being said, if other suppliers are able to arrange switches in the areas affected, then would this not suggest that the problem is unique to TE and therefore under their control?
Who knows!!

Still heard nothing about the switch and customer service doesn't answer the phone... 10 minutes and waiting at the moment. Best to call early or late? Awful music!

I eventually switched on 4th March.
More than 2 weeks later than the planned date !
Must of telephoned them at least 5 times over the last 3 weeks. They have always answered their phone after a 15 to 20 minutes wait !
Never had a reply to the 3 emails I have sent !1
