Hi Guys
I've been following the excellent advice on here regarding UKCPS since I received my first letter about a year ago. Basically I've ignored every single letter but I have now received a claim form.
In the particulars they have blatantly lied and said the driver agreed to pay within 28 days. I've never acknowledged receipt of any letters.
What next steps should I take please?

That is not a lie, it's been explained in numerous threads
The vehicle was driven on and off private property by the driver, signs show the contract on offer, and the rules, by being there the driver is presumed to have accepted the terms on offer, by conduct, its on the signs, the signs formed the contract
Offer , consideration, acceptance ( on the incident date, at the location )
UKCPS via Moorside Legal, issue date 7th February 2025
Study the newbies sticky thread in announcements near the top of the forum, second post, plus the first few posts in the defence template thread there too, then login to MCOL and complete the AOS online
Then study other recent UKCPS , Moorside Legal cases on here within the last few months, using Chan & Akande1 -
Ah ok I understand now why they I agreed to pay within 28 days.
I've been looking at the threads occasionally over the past year and really struggle to understand much of it, basically I'm as thick as two short planks when it comes to absorbing information I read, my brain can't comprehend any of it and I'm not computer literate so i'd never be able to a template letter and fill my own parts in, hence me wondering if I could just get them on what I had perceived as a lie with the 28 days remark.
Therefore I'll keep ignoring letters, even a CCJ as that wouldn't affect me due to my situation of never applying for a loan or any other credit again and my car insurance would be paid off in one lump sum for the year so a CCJ shouldn't affect my car insurance, unless I'm mistaken0 -
Just follow the advice on here, fight it, see how it pans out
The fact that you aren't worried about any future ccj is a bonus, but not a strategy1 -
With a Claim Issue Date of 7th February, you have until Wednesday 26th February 2025 to file an Acknowledgment of Service('AOS'), but there is nothing to be gained by delaying it.To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an AOS in a timely manner, you have until 4pm on Wednesday 12th March 2025 to file a Defence. That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.Don't miss the deadline for filing an AOS, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.2 -
Thanks for the help but I haven't a clue what I'm reading regarding how to fight it, it's too complicated even when I go to the threads I'm been advised to go to. I don't possess a computer so not sure I could do what is required just on a smartphone, the Dropbox with 7 pages is like trying to understand Urdu.
I'll carry on ignoring the letters including any CCJ and will update in due course
Thanks0 -
As long as you don't mind a ccj on your credit file nothing will happen2

A slightly cheaper alternative would be to pay up now. That will at least avoid any hearing fee.2 -
I'm too stubborn to pay up now even though I can afford to.
I won't pay the maximum amount by ignoring a CCJ as I will just continue to ignore all correspondence, therefore they can't get a penny off me.
I'll just have a CCJ on my credit report which won't affect me in any way.
Doing the defense route by copy and paste and all the other jargon like templates is just too difficult for me to understand, it just goes straight over my head when I try to get my head round it, hence me failing my GCSE's and been stuck in a menial job for the past 30 years🤣0 -
