You have had three years use from it. They are allowed to reduce any payment to you by a proportion to represent that usage. How much did you pay for it in the first place?
How do you know that the battery usage will reduce by so much if you've not tested it - is that from information that fitbit gave you? I have a versa 3 which has just had the new update and it is still lasting for longer than two days.

ETA - I can see some blurb after a quick search which says that battery life may be reduced but I can't see any confirmed information from google to say it will reduce to 2 days. Just going off my own experience where this hasn't happened yet although that is obviously anecdotal.
Hi,  fitbit/google are aware of countless issues regarding very low battery longevity and also display issues with this update.  They clearly have an issue here but are refusing to admit the problem.  I seen to remember a problem ba k in 2017 with another devi e having the same issue with the battery.  This looks to be a pattern with fitbit.  Poor design and manufacture.
So at the moment you have a strong presumption that there is a large impact on the battery life, but no actual evidence?
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

Unable to get evidence from my personal device as I do not have a charging cable because they didn't send me a replacment after sending mine back.  But there is clear evidence within the fitbit support network of battery longevity effected,  even at worst cases down to being charged twice a day.  These are cases that fitbit are looking into.

Then you need to ask them for a charging cable, or buy one.  You can't exercise your own consumer rights on the basis of problems other people are experiencing.  It's not like a car safety recall.

Did you send your original charging cable back with the watch? Having done it twice FitBit specifically tell customers not to send back charging cables with devices.

The OP stated they did return the cable:

Hi,  fitbit asked for the charging cable back so it was sent back to them.
The OP needs to request a cable from Fitbit (or cut their losses and buy a replacement cable online).

Is there a case to be brought against fitbit under these laws.

If so all the effected owners in the uk should start this.

Who do expect to start 'this' if not you?

What sense do you have. I have a sense 1 that is over 3 years old and I have no issues apart from having to jiggle the charger on the watch to start a charge. Much more fussy than apple’s flat magnet charger which just work all the time. Battery lasts the same as when I bought it used in Cex in May 2022 - about 6 days if I just wear it with no exercise measurements.

EDIT: What software version do you have?

Having had Fitbits replaced twice under warranty, when, thanks to us being covered by EU legislation the warranty was 2 years rather than the 1 year we have now because of Brexit, I never bothered replacing it when the third one went wrong at 3.5 years after the original purchase.

    Not fit for purpose IMO.
There has been no legislation in the UK that enforces any warranty to given, let alone of any duration.

Yes I agree there's the SADFART option, but let's face it, getting into a battle with an unwilling business is not something any of us want to get into, if there's an easier option available, which was the case when my Fitbit went wrong twice in the 2 year period of the warranty period as we were covered at the time. I contacted them, they sent me a new one. Twice.

The EEA have a longer warranty than even the US where it's made.
