    DCB Legal for Britannia Parking

    This one is another DCB Legal for Britannia Parking
    If you have already beaten Britannia, is this a near duplicate claim that could and should have been consolidated with the first claim?  Same location, VRM, parties, details (except PCN dates)?

    My mistake sorry I never saw this!

    Still waiting for the DDJ to make a decision on this claim, it's been 7 weeks at this point so a little bit anxious. I'm getting repeated letters demanding payment telling me I have a CCJ and DCBL won't take it off if I won't pay.

    (The first claim they made back in 23) They discontinued the claim last yearafter I filed my witness statement before the hearing.

    I stay for work in the hotel Sunday to Thursday. You pay for parking in the hotel bill in a single go at check in I.e. £40 for 4 nights, plus £260 hotel, total £300 as a single transaction.

    It picked me up before on a single day (I think the Tuesday night) despite having paid for the 4 nights combined. I went to the hotel manager etc who said they will request it cancelled, but Britannia refused, I then used that in my Witness Statement that the land owner wanted Britannia to cancel it but Britannia refused and said that the claim was being managed by DCB Legal.

    They discontinued it at that point.

    This is the exact same car park, claim type, VRM, parties, but a year later (maybe 2 years?).

    But if Britannia knew about both/all OCNs at the time of filing the first claim you can use Henderson v Henderson. Cause of action estoppel.

    19th February I received a response from DQ CNBC that this case was being referred to a district judge for directions, but it could take 8-10 weeks to recieve a response.

    I'm now on week 15 and still haven't recieved anything.

    I emailed DQ CNBC and asked how long the process would take, I recieved the auto-email stating a response can take 14 days. It has now been 16 days.

    I am getting almost daily aggressive phone calls from DCBL demanding payment, and I'm getting up to two letters a week demanding payment. I've also had a CCJ on my record now for 4 months, we were meant to be putting our house on the market in April but missed the Easter window because of the CCJ hampering mortgage options.

    I'm just stuck as to what I'm meant to do? Do I just have to sit and twiddle my thumbs?

    No you need to escalate it.
    Call them tomorrow morning at 8.30am
    Often set asides like this are happening within a few days so something has gone wrong
    get onto it first thing and and get onto the management
