    I sent my email to DQ, Case progression, Claim responses, and the CCBC complaints.

    I recieved the response from the DQ team (to me only, not reply all) telling me that I need to pay £120 and complete/submit the N244 form for a set aside. Do I wait for the others to respond to me too?

    The response I want to send is:

    Hello and thank you for your response. 

    This is not my error, I have followed all guidance and instruction from the CNBC as dictated, and evidence has been provided showing my compliance.

    My defence has been struck out due to the CNBC's error in processing my DQ form (twice), therefore why would it be on me to correct the CNBC error?

    Further why am I getting penalised and being made to pay substantial fees for an N244 application, and have my credit rating affected in the meantime due to the judgement, along with the fear of bailiffs turning up at my house for what is a CNBC error?

    Its been struck out because of the courts error, 
    You need to escalate this matter to the management team and insist its then put in front of a judge
    do not take the first response, their fault, 

    This is what i would do.  I would ring them up and get the name of the departmental manager in order to escalate,  Send the email you sent originally to the attention of said manager and ask the person to ensure that email is forwarded immediately to their attention
    do not accept any of their call centre scripted answers.

    11th February, I sent my first email to the 4 seperate CCBC addresses for DQ, complaints and claim response etc.

    Today is the 5th working day and I have still only recieved a response from the DQ team telling me to pay the fee for a set aside.

    I responded to that email on Thursday evening and still have no response from any party.

    How long is the expected turnaround? I'm very conscious that the second I haven't paid in the required time, I get a CCJ and my credit is wrecked (just rolled over to Very Good aswell)

    I will phone them but work Mon-Wed 6:30-18:00 in a no outside phones office, and so will have to wait until Thursday to call

    What happens now?!

    Email recieved from DQ team:

    "Please be advised that your case has been referred to a District Judge for directions on how to proceed, as your response wasn't processed within the correct time scale.

    It can take 8 - 10 weeks to receive a response at which point you will be notified accordingly."


    I've checked MCOL and it says judgement issued against me is the latest. So the current situation is still I have a judgement and have 30 days to pay it or I get a CCJ?! And then in 8-10 weeks it will be seen my a DDJ who will decide in my favour or not?


    I don't understand this process at all.

    The liklihood is that the judge will order the set aside and MCOL will be updated accordingly in due course,  then it will follow the usual process,  you will be notified at some point 

    You don't need to understand it, just follow the process after this interruption due to their mistakes

    It is good news: this means the DJ will order the mistaken CCJ to be set aside. Do not pay. That's the same email that others in this situation received.  It won't take 8-10 weeks.

    And the CNBC has admitted error:

    "your response wasn't processed within the correct time scale."

    You could send that to the C's solicitors but you don't have to. This'll be a temporary credit rating 'blip' that will disappear off your record in March, leaving no trace.
